I was bumped by a Simba truck at the robots (cnr Meteor str & Munnik str in Polokwane) on the 14th of September 2022, the Simba truck(CH14VBGP) driver didn't stop at the robots since it was a stop & go due to load-shedding. He admitted guilt as per the Accident Report and he also signed on the AR as confirmation of his statement. Ever since then I have been inconvenienced by this accident since I am not fortunate enough to have an extra car to use. Last week after a week that the accident had happened I contacted Simba wanting to find out what was happening since I was promised a call the following day after the accident and I never received it. I was referred to contact their broker Gencom risk who referred me to their attorneys ( BM - attorneys). The attorneys have been rude to me from day one of interacting with them, they ignore my emails, etc. They responded this morning since I sent them a follow-up email yesterday. On the email, I was advised that my matter is being attended to & they will revert back to me in due course. This is after two weeks of being inconvenienced: I now rely on uber( which is not a safe mode of transport since kids are abducted every day) to transport my kids to school which costs me +R130 per day, my son is currently having a concert at school so it is even costing me more since I have to go drop him off at school by uber at 16h30 which costs R105 for a return trip and go pick him up again at 19: 30 so in a day I am spending R340 which is money that I could be using for something else if it was not for that unnecessary accident that happened because someone didn't follow the rules. All I want is a courtesy to use before my car is fixed and to be compensated for all the costs that I have spent due to this unnecessary accident. I was also told by the bm - attorneys Recoveries & Third Party Specialist that "Our offices will not entertain ongoing correspondence that does not affect/ move forward the professional administration of the claim against our client". To me, this can only be said to be a person from a point of privilege since it is business as usual for them & their client whilst I am the only one who is being inconvenienced with my kids. I was also advised to get my attorney to contact them if I have any further issues; I cannot afford another car which is a must for right now, how on earth am I going to afford legal costs?
