Yesterday day 04/02/2020 att approx 1130,i had subpoenaed the mother of my second born child who was born out of wedlock in the year 2014....after numerous attempts to try and get the courts (family court, maintanance court and also social services), to assist me as the breadwinner of both my household and the situation with me and the mother of the child... In that they assist me in asking her as to where my child is, as I last saw him 3 years ago in person, before she decided against my own wishes to relocate him to the eastern cape citing unemployment. I tried to reason with the mother to leave the child with me as his father and I will carry on taking care of him whilst she makes a plan in getting a job for her self then we can all work towards one common goal... ***which is raising the child without any fights***. Armed with the referral letter from social services and family court and all the necessary supporting documentation in support of my defence of her stating that I am not maintaining the child... Where in fact I have been making debit order payments into the mother's account... The magistrate who is a lady in her senior years, refused to listen to my side of the story ***mind you I am the one that requested the lady to reason with me out of court as I honestly do not have a problem with her nor paying any monies that she may ask for the child.... The magistrate went and granted the lady a garnished against my salary even though I am already paying for maintanance. The magistrate further stated that I must go start the same route again of social services and family court to resolve the said situation, and I informed her that I have been through that route already but she didn't care and the subsequent actions that followed was that... The lady was granted R4500.00 to be attached to my remuneration, and was publicly humiliated in court in the presence of the magistrate where in I was Pepper sprayed in the eyes, kicked on the head and multiple times on sections of my body and then dragged out by members of the police service from the second floor of the building and then dropped on the front steps of the court entrance... Blinded, injured and with all the buttons of my shirt, pants and my belt broken... With everyone laughing at me and the police service members referring to me as a dog that is now apparently banned from entering the said court again as they only deal with money at that court and not interested in what happens to the child and his father. Mind you in all of this.... I never fought anyone... I just asked the court to assist me in asking the mother (where my son is? Is he dead or alive) I honestly don't know where this country is going to, where ladies spend so many hours in court benches to just embarrass and humiliate the one person that is actually doing something about the child's upbringing despite the fact that I am being restricted by the mother to see my own biological child. Should a man die, get arrested or become a criminal first before he can be afforded the same equal opportunity as the biological mother? Without being bullied by people without them first also assisting the father in asking the right questions. For me it is not about the money... I could give her the R4500. 00 same time yesterday without having to go the garnished route but still that was not considered. Clearly even complying with the courts still puts a man disadvantaged anyway. And now my only motivation is just to carry on working for a son that I don't know whether lives or is dead....all because a magistrate didn't want to listen to me and just said that I am a man.... And I must just take the pain and move on without even reprimanding the lady involved. This is all that I wish to state Deeply hurt father
