Below are the key details: Communication with Legal Representation: Ms. Bronkhorst has sent direct communication to me while being aware that I have legal representation. This appears to be contrary to the expected conduct for dealing with a party that is represented by an attorney. Demands for Immediate Responses: This attorney has requested same-day responses, knowing that I am entitled to a reasonable period to consult with my attorney before providing any response. Initial Lack of Awareness: At the time of the initial communication, I was unaware that I was not obligated to reply directly. Following this, my attorney advised her that all future communication should be directed through my legal representative. Continued Communication: Despite my attorney’s advice, this attorney has continued to communicate directly with me as well as with my attorney, without respecting the boundaries of the legal representation. Requests for Urgent Responses and Allegations: This attorney has continued to request urgent responses and made statements that have not been substantiated with evidence. This conduct has caused significant stress and confusion. I believe that this attorneys' actions may be in contravention of professional conduct rules, including: Rule 35.10: Regarding communication with a party who is represented by legal counsel. Rule 35.3: Unprofessional conduct. Rule 3 of the Code of Conduct: Duty of fairness and integrity. Section 36(1) of the Legal Practice Act: Duty to act with integrity.
