Dear Sir/Madam,
I am writing this letter as a formal complaint regarding the continued harassment by your agency and other collection agencies regarding the above-mentioned account, despite the debt being fully settled.
Background:
1. On 03 June 2025, I was contacted by a representative of your company regarding an outstanding balance on my Direct Axis account. 2. On 29 November 2025, I entered into a payment arrangement with your agent (whom I believe was referred to as "Rearat"). Pursuant to that agreement, I authorized a debit pull from my Capitec Bank account, and the full outstanding balance was settled in its entirety on that same day (29/11/2025). 3. Despite numerous telephonic attempts to follow up since that date, your agents have failed to respond to my queries or provide me with the required Paid-Up Letter as proof of settlement.
Current Situation: Because your company has failed to provide me with proof of payment and failed to update the credit bureaus, I am still receiving daily collection calls for an amount that I do not owe. This constitutes harassment and a violation of the Debt Collectors Act and the National Credit Act.
My Demands: In terms of Section 72 of the National Credit Act and the regulations of the Council for Debt Collectors, I hereby demand that you provide me with the following within 7 (seven) calendar days of receipt of this letter:
1. A formal Paid-Up Letter (Certificate of Balance) reflecting a R0.00 balance on the account, confirming the debt is settled. 2. Written confirmation that you have updated the credit bureaus (TransUnion, Experian, etc.) to remove this adverse listing or reflect the paid status. 3. Confirmation that the matter is closed and that you have ceased all collection activities.
Cease and Desist Please take note that I dispute the validity of any further collection attempts. Should I continue to receive calls regarding this settled debt after the 7-day period, I will have no choice but to open a formal complaint with the Council for Debt Collectors (CFDC) and the National Credit Regulator (NCR) without further notice to you. I will also hold your company liable for any damages caused by the continued listing of this settled debt.
