Swart and Nel Attorneys (Pty) Ltd, 54 McIntyre St, Parow, Cape Town, 7500 and the Developer a certain Gilbert at Kings Court complex, Kings Road Milnerton Rural Cape Town 7441, has been deliberately and fraudulently delaying the Rates & Taxes application with the City of Cape Town for months in order to deliberately make homeowners pay Occupational Rent. They have also refused to construct privacy walls for HomeOwners after Property Agents included the walls description in their marketing. We, HomeOwners are now in the month of September 2018 and some Home Owners have been paying Occupational Rent as far back as December 2017. Swart and Nel Attorneys (Pty) Ltd has been blaming City of Cape Town Municipality for the delay in approving the Rates Certificate application. This is a lie, City of Cape Town Municipality is one of the most efficient and fasted Municipalities in South Africa. All new & old Properties in South Africa must have a Rates & Tax Certificate so that Municipality can bill you properly for water and electricity. The legal and correct procedure that Swart & Nel Attorneys is supposed to follow is that before applying for Rates Certification with the City of Cape Town, they are required to register with Korbitec'sRatesClearance.com before obtaining approval from the City of Cape Town for Kings Court Milnerton Rural Cape Town 7441. Both the Developer and Swart and Nel are aware of the correct procedures to follow! Even City of Cape Town communicated the procedure to follow to Swart and Nel Attorneys. They are not new to the game of property construction. All in all, until Kings Court complex ERF 6305 obtains a Rates Certification (approval) from the City of Cape Town, Home Owners will be required to pay Occupational Rent. Perfect way for the Attorneys to delay the process and make Home Owners pay Occupational Rent. Mind you, Home Owners still haven't received their Rates bill. They will be shocked when the bill arrives. An entire 9 months delay. City of Cape Town Municipality clears Rates application within a period of maximum 2 weeks. 2 weeks!!! NOT 9 (nine) Months. So what Swart did, was not follow procedures with Korbitec'sRatesClearance.com . As a result, the City of Cape has not approved Kings Court Rates Application. In the mean time, Swart charges you Occupational Rent and blames the "delay" on City of Cape Town. Regarding Transfer fees, Swart & Nel Attorneys inserted different clauses for each Unit sold. Some Units are expected to pay Swart and Nel Transfer Fees. Some have been exempt from paying Swart and Nel Attorney Transfer Fees. Legally we are all supposed to get the same Contract e.g either we All pay Transfer fees or either we are All exempt from paying Swart and Nel Attorneys. As Home Owners we compared our contracts and realised that a blanket approach has not been implemented. Again, unethical and Fraudulent. Home Owners were only supposed to pay Attorney fees to Swart and Nel after they have signed the final Deeds documents and Rates Certificate has been approved by City of Cape Town. The signage is only supposed to take place after the Rates Certificate has been approved by City of Cape Town. Unfortunately, Swart has invoiced and made some Home Owners pay the Attorney fees. What the Developer and Swart didn't know is that we would investigate and dig deeper. Something was amiss, they were not expecting us to find out and educate ourselves. Home Owners are in debt, taking out loans to pay exorbitant Occupational Rent to the delay on the part of Swart and Nel and Kings Court Developer. I have never been so disgusted in my life. What a shame. These people do not deserve to Practice Law in South Africa and the Developer (Gilbert) must never construct again in South Africa. Enough is enough, the truth is out. We want the Rates issue to be wrapped up and we want to stop paying Occupational rent for homes we own. We want our privacy walls to be constructed. We want to occupy our Homes and pay Bond instead of Occupational Rent. The Law Society aught to know what Swart and Nel and the Developer Gilbert have done to innocent vulnerable Home Owners.
