Cell Tower Invasion

Good day Sir / Madam

My name is Fazeela Gattoo, my husband name is Muhammad Iqbal Suliman Gattoo.

We have bought a home in Cresta and moved in November 2019, when we bought this home we both loved the area it was a peaceful area, and us being animal lovers we thought it would be awesome living space for them as well. Stunning home with a lovely landscaped Garden, quite peaceful area on Judges Avenue.

Everything was perfect until June 2021 when our neighbors suddenly started digging and renovating, while the construction was taking place the neighbors wall started falling into our yard. We tried calling our neighbor, to let him know that hes wall including the electric fence is being destroyed by the construction workers, and that the wall is falling into our yard.

Then we enquired by the workers as to why they were digging so deep to renovate, that is when we were told they were putting up a signal tower. We tried contacting our neighbor to ask about it, he then said that this was decided on two years ago, meaning before we had moved in. We were nit consulted or even did neither the contractor or our neighbors bothered to inform us. So in other words he tried to tell us everything now was done and we just had to accept what was happening and it is happening literally right in our home as this huge tower is right on the Boundary of our home.

At this stage we still had no idea of how huge or high this tower would be, we accepted it as we did not want to make a fuss and be annoying and finicky neighbor.

When we bought this home it was perfect from the time we bought it till this horrid structure that sits right in our perfectly landscaped garden that we fell inlove with is now ruined we have never signed any sort of petition or agreement that it was okay to disrupt our view our home and space when the technicians and construction workers constantly making a noise since the erection of the tower.

Every week we have workers parked in front of our gate screaming and shouting to one another, banging car doors and blocking the whole of Judges Avenue.

They would park right in front of my gate, bang their car doors on a Sunday morning especially when you would like some peace and relaxation. one technician on the top of the tower is screaming to the guy on the ground and this goes on for hours.

Despite the fact that we tried complaining to the mess that was made in and outside our home we could do nothing.

So our neighbors is getting paid a rental for this horrid tower to be in his yard, to be honest this tower is literally in our space, we thought since we couldn't do anything about it as our neighbor said that all the neighbors on Judges has signed a petition to say that it is okay to go ahead, none of the neighbors know of any such signatures or agreement.

I would of just let it go, but it is 2am and I cannot sleep because of the constant ringing and vibration that echoes in our bedroom because of the machinery that is running. It is actually generator running, Day and night it sounds as if generator or a truck is idling in our home. The fumes is now causing us headaches and my baby Grandchild living with us continually coughing, the fumes burns our eyes. My dad has stage 4 cancer and im worried about the health issues with him as its affecting us all. I tried so hard to protect him from covid and now i have to worry about this tower and what it gives off.

This constant ringing is driving me crazy. I don't know how we are going to live another few years like this, nor would we be able to sell this home and get a good price for it or even what we paid for it as this tower is bringing down the value of our home.

with this horrible tower and the noise it gives off. This feels like a nightmare and there is nothing we can do about it. Our neighbors seem to have a great sleep while this tower is right on the boundary of our home. It is nowhere near there living quarters instead in our front yard, we can no longer enjoy our beautiful landscaped garden. The noise echoes into our entire home, and yet we didn't agree to this and inconvenience it is causing in our lives.

My daughter being in second year varsity cannot concentrate as this ringing and vibrations causes distraction. Neither can she attend study calls because it sounds as though there is a truck idling in her room. It's worse when she tries to study at night all you hear is that noise. I would like to attach some pictures of the tower, so that you can see what I mean when i say this tower is literally in our home, i feel this is very unfair, we have tried to accept it and be good neighbors but honestly this noise abd smoke of generator is becoming unbearable, please help us as we do not know what can be done about this.

This tower is bringing down the value of our home. It was done without our consent and our neighbor didn't even have the decency to tell us before they started to make us aware of this. Instead we had to try and find out what was going on and it was too late. For months my home was constantly dusty with all the mess they made in our yard.

now we cannot sit in our garden because of the noise and fumes.

Please can you advise us as to what can be done about this and to whom we can forward our grievances? Your advice would be greatly appreciated.

I have contacted our ward councilor but she seemed to be to busy to reply to my messages. We called then she said theres nothing she could do. We living with this diesel fumes and genie noise day in and day out. We are so frustrated and very upset to have such a pathetic neighbor to do this without consulting with us till today he hides , he will get his. Karma
