I'm was residing at 2567 in Greenfield, Maclear. The authority to occupy this house was granted by the Elundini Municipality with the help of Mr PS Memani, who was the manager in housing department in the year 2016.
There is Siphi Mayibenye who claims that the house belongs to him. Siphi and Nandi who I guess its his wife are calling and sms which I find it unprofessional due to 1. House was given to me by municipal official and there was a contract signed 2. The councillor has no authority to instruct my neighbour to open the house without my consent or instructions. The neighbour has my key and not allowed to give it to anyone unless I have instructed him.
The councillor called me on 26th April and asked me about the house and I explained that I'm in Cape Town and I can't come back because of lockdown. We agreed but now they are telling me that it was open for 7 days and I didn't come back. These guy including the councillor itself, knew that the municipality offices were closed. The reason why I need the municipality to intervene on the contract its says the owner must give me 3 months notice and shall pay all expenses I paid to fix the house and he told he cannot do that. I was waiting for the offices to open. I was suprised when they forced my neighbour to open because the councillor and the police gave them permission to do so. I believe both parties acted uncivilised in this manner because they know the lockdown regulations that to move from one province to another province you must have a valid permit.
I have find it wrong of the new owner and his wife to be granted permission to occupy the house by the councillor. They were inside the house and telling me they are writing down a list of my stuff, even the main bedroom that is locked they will open it. They gave me options 1. To ask someone to take my stuff 2. They will use my stuff 3. I must pay rent for them. I asked them to give me chance until Monday as I know the municipality offices will be open that day.
Mr Gashi I have signed a contract with the Elundini Municipality and was advised that when the owner of the house found, the Elundini Municipality will contact me in writing advice me that the owner has been traced and found not the owner harrasing and breaking in the house with the councillors permission and the Police Officers. The contract that I have signed at the municipality offices that time constitutes a formal and legal arrangement which is now being breached.
As the tenant that was given authority by Elundini Municipality office, I expect no one to talk to me not unless the person is from Elundini municipality to give me a 3 months notice in writing. The owner of the house should contact municipality offices not me. They have done an illegal break in which I will open a case against them. Even those messages they've sent to me will also take legal action against them.
On the 2nd of June 2020 they were in the house calling me names telling me they will break in and the councillor was there also. I ask the Station commander and Mr K Lingani who is a Legal Practirioner to assist because the Maclear police can assist. I'm trying to get a permit so that I can come down to sort this problem out. As he not willing to pay I have to take everything out that I fixed. I don't have a problem to move out because I was advised that the owner of the house will claim and the contract doesn't give me the ownership of the property.
The Ward Councillor Vuyiswa Nthabi came with a letter to me with wrong names and ask me to vacate the house with immediate effect. On the 28th January 2021 4 ladies came shouting and swearing at me telling me to vacate the house and the Ward Councillor came with police telling me to vacate the house with immediate effect. I called the municipality offices and I was advised to vacate there's nothing they can do. When I signed the contract I was not advised that they told me municipality will write a letter to me and the owner of the house will give three months notice and whatever i done on the house he/she will pay. The municipality and the Ward councillor didn't follow the correct procedure. Ive to vacate the house same day and my furniture is damaged because I've to ask to neighbour's to keep my stuff. I feel they were unfair to me because if I didn't stayed in the house it was going to be vandalized. Is this the correct way that the Ward councillor and the municipality thanks me for saving their house. That family now are my enemies even the Ward councillor is my enemy. Is it the right way that was done by the municipality. The names on the letter is the one I used when I signed the contract. I'm married so I used Mercy Dyasi and the letter is *****ba Macupe. The people that are staying there are not the owner neither his kids, its his niece and she's married to Mayibenye family. The municipality didn't follow the correct procedure.
