We are South African residents living abroad so easy to be taken advantage of. Signed OTP for a development property. EVERY single document was signed electronically which is not binding. Not once was ink put to paper. Obtained a bond offer from Standard Bank. Shortly after, my salary changed significantly. I firstly advised Standard Bank about my change of circumstances who instructed me to contact the transferring attorneys. I contacted ESI Law several times to tell them I could no longer afford the property due to a significant decrease in salary. They IGNORED MY EMAILS FOR 7 WEEKS!!!!!! I requested documents which went unanswered. For example, had the developer secured finance from the bank for this specific development. ESI law is very quick to make demands yet completely ignore relevant questions. Pieter Goosen sends a letter of demand for LOSS and WASTAGE to the amount of R78,000 on top of our R50,000 deposit they are still withholding!!!! I don’t understand why, as the property has been sold on. They refuse to give us our R50,000 deposit plus interest back after communicating our affordability change. We have approached the Cape Law society and still waiting on feedback. We did not set these developers back in any way. Upon contacting Standard bank on 27/10/2022 we were informed that they cancelled the bond on 1 August 2022. So where is my money? Standard Bank also mentioned that Esi Law is in dispute with the developer regarding our deposit. I do not understand that after all my emails and queries, no one bothered to contact me to let me know the bond had been cancelled. I can safely assume this information was conveniently withheld, as a means to hold onto our R50,000. This is CRIMINAL; from people who are supposed to uphold our legal system.
