Bought a used BMW X6 from HMG Motors (Highway Motors Group) in Klerksdorp on the 4th November 2022. I financed it through Standard Bank, and proceeded to drive it back to Durban the following day Saturday the 5th. On entering Clarence the sound system just freaked out and was crackling so loudly that my wife and I had to get out the car. Switching the engine off and locking the car from the outside did nothing, and only after Googling how to disconnect the sound system in the boot were we able to continue our trip to the guest house. I notified the salesman Gavin right away of this issue on WhatsApp, and he said we would address it on Monday. Sunday we continued down to Durban, and about 10km away from King Shaka airport where my wife parked her car to fly up and join me for the drive back, the X6 lost all gears and I had to pull over on the N2. Only after I restarted the car were we able to continue on. This has been happening ever since. On Monday I sent an email to the dealer and bank saying I wish to return the vehicle for full refund as it was faulty. They then came back to say they would not accept the return and would repair it, something I'm not happy with so opened a case at the motor industry ombudsman. The ombudsman ruled very quickly in favour of the dealership closing the case and saying they must simply fix the problem. Here's where it gets crazy. While the ombudsman was deliberating we also worked out that the car had had some major bodywork done to it, and been resprayed on both front and rear bumpers. Water was now also filling the rear tail lights up when it rained, water was trickling into the drivers side footwell, passenger side mirror was not adjusting, passenger fog light was now falling out, overspray and paint runs and various other smaller issues had come up, all of which I reported to the ombudsman. After they ruled and closed the case, I highlighted all the other issues to them once again, and they reopened the case just to close two days later for Christmas. While they were closed I got quotes from 3x panal beaters, 3x gearbox repair agents (one of which HMG Motors referred me to as their prefered repair centre in Durban) to address these issues, as well as reports from BMW Durban on the overall status of the car, all sent to the Ombudsman. During this whole investigation process, I got hold of the previous owner who confirmed that he knew about these issues as well as showing me photos of the car before he sold it to HMG motors where you could see the previous body damage. Let it be known that HMG Motors did tell me that they repaired some scratched above the one sides front and rear wheel arches, but never mentioned the bumper repair and respray. It's now been 3+ months and I have no answer or feedback from the ombudsman, I just get told to wait as these things take time. All while I'm paying for a car and insurance there of without being able to use it...
