On 13 July 2021, I consulted with Jiyane Attorneys and instructed them to draft a trust account on my behalf. Subsequently, on 14 July 2021, I received a quote of R6 800.00 from Jiyane Attorneys for the drafting of the. trust deed. Nontsi Jiyane informed me on e-mail that The Deed takes 7-10 days to be drafted as it is between 25-40 pages depending on the content of the same. I instructed her to proceed and told her that payment would be made in two parts with the first payment to be made at the end of July 2021 and the second payment at the end of August 2021.
As agreed, the first payment of 50% was made at the end of July 2021. The balance of 50% was paid in full at the end of August 2021 so my invoice was paid in full by the end of August 2022 before their services were rendered. I sent Jiyane Attorneys all the documents required for them to draft my trust deed as well as those for my appointed trustees.
Months passed by and on 14 October 2021, I followed up with Nontsi Jiyane of Jiyane Attorneys with regard to when I will be expected to come in and sign my Deed of Trust and all relevant documents pertaining thereto. She, Nontsi Jiyane, informed me that she had experienced a few COVID19 contact cases at her offices and that is why she had not called me to come in and sign the Trust Deed yet. She further informed me that once all docs are drafted, I can expect a call from her Secretary to come in and sign.
The Secretary called a few days later and we scheduled an appointment for 29 October 2021 at 10:00. On 21 October 2021, Nontsi Jiyane sent me a text for an alternative date to sign and informed me that she was held up in court and could therefore not honour our appointment. We agreed once again that her Secretary would call me for an alternative date to sign when she is available. I waited for the alternative appointment date. I sent a follow-up email for an appointment on 07 December 2021.
On 17 December 2021, Nontsi Jiyane sent me the Trust Deed, J417 and J401 for signature on e-mail. I sent a subsequent e-mail after receipt of the documents that my will, which was supposed to be part of the pack of documents to be signed, was not included and that I would only sign ALL documents as agreed between us once she sent the will. Her firm closed a few days later for the December 2021 Christmas holidays.
On 10 January 2022, I followed up on the outstanding will. I also gave Nontsi a call and she informed me that her firm was not open yet and that she would attend to my outstanding matter upon her return in mid-Jan 2022. I received no call from Jiyane Attorneys. On 02 February 2022, I sent Nontsi Jiyane an email requesting her to amend the trust deed because one of my trustees had just gotten married in November 2021 and had applied for a new ID. I followed up on that request with the updated ID copy.
Nontsi Jiyane stopped answering my calls and e-mails and did not do the amendment on the trust deed with my trustee's new ID copy and neither did she arrange a signature date for my trust deed even after I paid her R6 800.00 even before she delivered her services. Jiyane Attorneys breached our contract and did not deliver their services as agreed.
Please intervene so I can get my refund and appoint another attorney to draft my Trust Deed.
