In July I Phillip Loggenberg instructed Theresa Pohl who managed the rental of 9 Kurkboomb at Berg en Dal Estate, Chancliff, that I terminate the rental end of July and whereby she verbally confirmed this was is order.
I called her again at the end of July to confirm whereby she was also at the unit where I verbally confirmed and instructed her that I was termination occupancy.
She confirmed that all was in order for providing a month in advance termination of occupancy, as per agreed rental contract.
At the end of August the 25th I vacated the unit rented and she told me she was going to meet me on Friday morning whereby Gunther was there to do the inspection.
Gunther confirmed that all was in order and I handed him the keys and asked him if there were going to be any additional requirements from my side before I left and he replied there was none and all was in order and that there were no cost incurred prior and after cleaning the unit.
When I requested the deposit back from Theresa Pohl she verbally told me that I wouldn't get the deposit back' because I was in 'breach of contract', which I was not.
I then called Lennen, the owner and she asked me why I was calling her and told me she was going to get back to me, which she never did. Theresa further said during the time that Lennen would be doing the inspection and 'decide from there' and kept on saying I should speak to her to get the deposit back which was not my responsibility, but hers as acting agent for Keywest Properties.
After this discussion I went to Keywest Properties in Viljoen Street Krugersdorp and spoke to Corradina whereby she called Ansie (the principle) and said we should speak to Alta, which then called me back explained to her the situation and didnt get much resolve.
I ended up going to Keller Williams for help and explained to them the story to ask for advice and they informed me that I was well within my right to claim for the full deposit as there were no additional penalties waivered and mentioned that I should contact the EAAB and explain my story.
On September the 1st after numerous calls and expenses on my behalf I was paid only R5000 deposit, and not the full amount of R7500 and thereby during this time and after had to borrow again money for the remainder for rental owed which further caused more issues as this was promised to the landlord.
I spoke to Theresa again after two weeks and asked her for the remainder of the deposit as I needed it whereby I sent her proof of the payment made originally to the sum of R14,770.00.
I wish to state that this whole affair caused alot of issues for me and put me under sever stress and also indirectly affecting my health and living conditions.
This could have been avoided if Theresa just lived up to her promise and paid the full amount and not R5000 as 'a token of goodwill' according to her and Ansie, which is what I 'deserved'.
I lived up to my promise regardless of COVID and fulfilled my obligation to Keywest Properties and didnt miss any rental payments during occupation during this period and had to borrow money to pay the remainder for the month in order to get the deposit back.
I sent Theresa the proof of the deposit she requested and claimed in Whatsapp that the deposit was paid by my boss and not me, where it clearly states that it was paid from my FNB Cheque account. Also she commented that she was no longer working for Keywest Properties and cannot pay back the money which is all a lie, not to pay the additional R2270.
Since last year 1 September I have had absolutely no reply from Keywest Properties at all.
