We were brought a buyer that promised that she had the funds for the deposit. We were explicit in our requirements for not being held up by the buyer. The agent said they did their checks on her. Push comes to shove the buyer they brought us has lied about having the deposit funds available and the contract that Menlyn Properties provided has serious flaws that ends up costing me money. The contract says that the buyer only has to pay deposit on transfer. It could have rather said pay on transfer but provide gaurantees on an earlier date. James is unapologetic and says his contract is perfect no matter what other lawyers say. Perfect for him maybe but not clients which have increased risk due to having to pay clearances and such all before the buyer shows they actually have the funds to pay. This is a serious lack of foresight in their contract and they don't explain each clause to you either as mandated by the CPA. His words: \just report me to the consumer protector if you want".
