My wife and I bought a used Mercedes Benz CLA 220d A/t in July 2020 from Mystic Cars in Ballito, the car was said to be in an immaculate condition with Full Service history proved to be a disaster from the day of its delivery. Within 4 months after travelling only 3000 km the vehicle had a gearbox brake down, the dealer was notified but refused to fix the car, we then locked a complaint with MIOSA. Its during this period that we discovered that the Service Records were inaccurate, misleading and not tallying with the odometer. MIOSA investigated the matter and recommended that Mystic Cars repair the vehicle inline with the Consumer Protection Act, again the dealer refused to honor his obligation despite the 6 months Imp**** Warranty of Quality given by Sec 56 of this Act, the matter was then referred to the National Consumer Tribunal NCT for relief. After 2 years of intense submissions and representation, the case was Set Down for the 26th January 23. In its Judgement the Tribunal found that Mystic Cars committed prohibited conduct, being an act or omission in contravention of Sec 55(2)b read with 56(2)b of the CPA and ordered Mystic Cars to Refund us the Full purchase price plus interest for the duration of the deal. Further more the NCT issued a Certificate in terms of Sec 115(2)b to institute proceedings in the High Court for damages. All is well that ends well.
