Hello Peter

My husband and I found a beautiful apartment in century city just before we got married. We were told that we could move in a week into the month of March because the rental agancy we used: platinum century property had to paint and fix things in the flat after the previous tenants moved out (i was really impressed with them!) but then the one week went over to almost 2 weeks, anyways a few complaints later, we moved in!

A month after moving in (as winter was approaching) i noticed some black patches growing on the bedroom walls but i was not too concerned. we went away for about 5 days and when we got back the flat was covered in mold.

This is where the story gets messed up. We live with our then 14month old baby who suffers from asthma and chest problems (if you know about black mould, you will know its deadly to infants). So, i contact the lady who i signed the lease with and advised her of this infestation growing in the apartment. I was in communicatiom with them for almost 2 months speaking back and forth to different people, begging them to do something but i was at the end told it is my problem and I must fix it, KLAAR! infact i was told to open windows and buy a humidifier because there are no air vents.

Anyways

At this stage my child is in a perpertual state of sickness and struggles to breathe especially at night, going in and out of hospital. We had hit a brick wall. We couldnt continue living in the state the apartment was in (we couldnt exactly walk out of our contract either) so we decided to clean the mold weekly to minimize the effects and move the baby to live in the lounge. you heard right, our child lives in the lounge where the TV plays.

So here it is.

1. We are renting a 2 bedroom apartment for 12000 pm and we cant use the bedrooms because of health risks

2. We are paying to maintain this mold so that the place can be habitable enough for my husband and I to use the bedroom atleast for 2 nights of the week, the other days we utilise the couches in the lounge!

3. Our medical aid funds have been depleted

4. Our clothes, curtains and shoes are covered in mold, so when we do move out we will have to start buying things from scratch again.

We feel cheated of our money and mistreated because they have made it evident that our childs life doesnt matter. These are the same people who send us an email on the 27th of every month to remind us not to forget to pay rent on the 1st. The irony.

Because we are so frustrated, i contacted a building inspector and paid him to come and do an assessment of the place.

We have been advised that even animals wouldnt be kept in such a toxic place. YET they put people there..

I have taken my case to the tribunal but for me that is not enough, i want them to pay for making our life what it is now. .the constant visits to the hospital, being unable to fully utilize an apartment we are paying for, and the fact that our clothes, furniture and curtains have now in an unusable state.

Am i unreasonanle for wanting Justice and a way forward with this for my family?
