My sale of Agreement with Balwin properties was canceled in December 2020. The bond assistant sent a cancelation email confirmation that the agreement is canceled. The email also mentioned that Estelle from TC Attorneys will contact me regarding the banking details and my deposit. I received an email from TC Attorneys requesting proof of banking details, if which I provided, I got no response or any communication about my R10 000 deposit that is now sitting in their account. I sent couple of emails, till today I have not been responded to. I called Estelle yesterday, she said she is aware and is going to send me an email shortly, I waited the whole day today. I really don't understand how they do business. Very disappointed... I NEED my money, now more than ever.
Warning! Please do a research on Balwin Properties before you even think of going to view any of their properties. If you decide to go view, please do not let the sales agent convince you on signing any document. I went to Greenlee, Linbro Park, Sandton to view their apartments and to get information on the 4th of June 2020. The sales agent told me to sign a sale of agreement. I told her that I would like to see if I will be able to get a bond approved by the bank and if any bank approve the bond 100%, I would want to look at my finances and also consider any other costs (Rates, levies) in order to make a decision. The agent said I can cancel anytime if I am not happy with bank offer and if I see that I will not afford the property. She also said the deposit is refundable, so I thought that was just to book the apartment, but not to buy it. I paid the deposit (R10 000) the following day, 5th June. Once everything was done and received the bank offer, I emailed the bond assistant so I can cancel. I never received any response instead I was called by the agent and she told me that if I cancel I will not receive my deposit back, I explained to her my reasons. 1. I will not afford to stay at the property. 2. I also had doubts after seeing the reviews on Hellopeter. She managed to convince me after a long conversation, she said I can always sell or rent it out later if I am not happy and cannot afford, she said I will make good profit. I also did not want to lose the deposit, R10 000 is a lot of money. I regret this from the bottom of my heart and mind. After a month, I changed my mind again and sent the bond assist an email telling her that I would like to cancel and I am sticking to the decision I made previously to cancel, and at this point I was willing to lose the R10 000.I was then told that I cannot cancel and will need to to proceed with the sale as per my SOA. This was news to me because previously when I wanted to cancel I was not told that I cannot cancel but was told I can cancel and will not get my deposit back. On 11th November 2020, I received an email from the bond assistant asking if I can provide proof that I can't afford to stay at the property. I then received a call later that day from a guy at Balwin properties saying that I cannot cancel, the SOA is legally binding and if I don't go ahead with the sale I will be liable to pay R400 000 for breaching the agreement. I have sent the proof they asked for, I am waiting to hear from them now. I feel that I was lied to by the sales agent right from the start. Not that I didn't read the document, but we went through it together with her explaining the clauses, but didn't explain THE IMPORTANT clauses. She never even told me that if I get approved by the bank and decide to cancel I will not get the deposit back or I will be forced to go ahead with the sale. Instead she said I can cancel when I wanted to. You also cannot get the copy of the Agreement, you only get it later after the application is sent to banks. I regret the day I decided to go view. I regret signing the agreement, it feels more like signing a deal to sell your soul. I regret not doing proper research before I went and made the biggest mistake of my life. But I have learned a lesson. So please, if you ever decide you want to purchase any of their property, PLEASE think carefully about it. Do not sign any agreement with the sales agent. Do it only if you are SURE that you want to buy.
