I got a car from ohmy cars in pretoria on the 18 November on the first day the car started giving me problems by loosing power, the starring was hard the brakes making noice, There was black smoke comming in frond and on that fist day I reported to plannet and oh my cars ,I was told that the reason is that they did not service the car they will book it for service,The following week the car was booked for service and after the service I got diagnostic that the car has other problems that need to be fixed then I informed the dealership and Planet and the dealership asked me to take the car for second diagnostic were I stay and I did it did correspond with the other andthey said they will reimburse me for that, I did send the results again to the dealership and planet 42, and the dealership informed me that they have a workshop they will fix the problem they requested for me to bring the car. In march I managed to take the car back to their workshop and it speeded a week and on the day of collection I realized that the car still loosing power and I informed them ,They told me they will arrange with other workshop that usually fix their cars, it was about 5 months then. I did keep on asking them when will they fix the car because I have been paying for 5 months but the car is not fixed they did not respond my messages, on the 16 May 2023 I wrote a message to planet and the dealership after sales that I am terminating the contract and their car will be delivered at the dealership by the 25 May because they are failing to book and fix the car and on the 25 May I paid my 6th installment, 3 days later I received the call from aftersales that they did book the car somewhere in pretoria and I should deliver the car there to be fixed which I did. 15 Days later I phoned the workshop asking if they are finished with the car then the workshop told me they did send the dealership the quotation but they are not responding. I phoned the dealership to ask why they dont respond to the workshop because they have to pay for the car now, They told me the guy called Richard who was responsible and booked the car has resigned,no longer working for them so there is procedure they must follow so they are still busy. 1 day after I phoned the dealership asking how far are they with their process they told me I should call the maintanance insurance and complete the claim which I did. I found out the insurance only pay 8500 and the quotation is R43000. I asked the workshop what can he fix with R8500 , The workshop said nothing can be fixed on the car with R8500. I phoned after sales that nothing can be fixed on the car for R8500 that means the car do not have insurance then They must pay, They said they did engage with planet and waiting for their response ,on the same day I phoned Planet42 and ask about how will they deal with this problem they said they did engage with the dealership and waiting for their response, 3 days later same response from both waiting for each other ,then I informed planet that since they are waiting for each other then my termination of contract states that I wrote on the 16 of MAY.June the 25 I did not pay then I received a call from planet that I did not pay told them I have terminated the contract on the 16 May and the car was delivered at the place given by the dealership ,i don't have the car with me.July I received another call that May and June payments are outstanding,Then I expalin that I terminated the contract in writing on the 16 of May Then I was told that The contract is active and I owe Them. I told them I dont have any contact with them ,they guy said they will not terminate the contract and I owe them.Last week I received a call that from planet 42 the guy said they are willing to take responsiblility of fixing the car and cancell August and september payment if I am willing to pay June and July installments, I told them to do it in writting which they did and I responded them that before I pay anything they must send me the prove of payment of the car R4300 to the workshop and they must deliver the car then I don't have a problem to continue with the car. The respond was that they will contact the workshop to arrange collecting the car and statement will be send to me. I need to know what statement because1. the faults were reported on the first day,2. I have terminated the contact on the 16 May,3. I paid the 6 months for the broken car that they kept on promising to fix it and never did.
