Breach of credit agreement by SA Taxi Finance
BREACH OF CREDIT AGREEMENT AND FAILURE TO PROVIDE STATEMENTS DUE. I am writing on behalf of my friend, his account no is 104133:094431, to complain about the way my friend's credit agreement with SA Taxi Finance has been handled. There have been a number of issues, ranging from the failure to issue monthly statements, to the settlement letter and statements issued by SA Taxi Finance being inaccurate, and the failure of SA Taxi Finance to issue the monthly statements my friend requested. The credit agreement started on 5 February 2019 and was for funding a taxi for trading purposes. The term of this credit agreement was six years as per the signed credit agreement, with the expiry date being 1 March 2025. The credit agreement provided that the agreement would conclude with 1 March 2025. My friend has not received the monthly statements as per the agreement. He has requested several times that the monthly statements be issued. This has not yet been done. He has requested several times to receive a settlement letter regarding his arrears. The only settlement letter received is dated 29 April 2026, which is over a year after the agreement had concluded. The settlement letter was accompanied with a 6-month statement. Both the settlement letter and the 6-month statement have made the following assertions: • The agreement was for a period of seven years with an expiry date of 2026 contrary to the actual agreement being for 6 years with an expiry date of 1 March 2025; • The account has been in arrears every month contrary to the fact that there are no monthly statements and the agreement provided for monthly payments to the credit provider. The settlement letter and 6-month statement demanded payment of the arrears as well as the monthly payments despite the agreement being concluded. My friend has attempted to contact SA Taxi Finance to seek clarification of this matter since receiving the settlement letter, however, he has been unable to get hold of them through all channels including telephone and WhatsApp. In the circumstances, my friend request that SA Taxi Finance take the following steps: • Provide all monthly statements from February 2019 to March 2025 as per the agreement. • Issue a settlement letter, which is accurate and which accurately reflects the 6 year agreement as per the contract, and acknowledges the agreement having an expiry date of 1 March 2025, as well as the arrears, if any. • Remove the arrears as demanded by SA Taxi Finance in its letter and statement. • Provide him with a point of contact, as my friend has been unable to contact SA Taxi Finance since receiving the settlement letter.
