I entrusted this dealership to sell my vehicle on consignment. The car sold on 12 June, yet over five weeks later, I haven’t received a single cent. Our contract required payment within two weeks, but the dealership promised payment by a date even later — around 11 July — which they missed. Initially, they blamed FICA, then switched to “cash flow issues.” They admitted to “acquiring funds” but never confirmed these were from my sale. The sale funds were received on 12 June, so they should have paid me. I am not a creditor to them; they had a legal duty to pay me promptly. Claiming they don’t have the money is a clear breach of agreement. By saying they are “acquiring funds” to pay me, they’re effectively admitting they don’t have my money and are treating me like a creditor. As my agent, they must keep my money separate and pay without delay. Withholding my proceeds under the guise of cash flow problems could be ******** withholding or even theft, since the sale funds exist. This breach of trust is why I’m pursuing legal action. After their promised payment date passed, they went silent — no communication, no proof of payment, no updates. I’ve raised this with Mervin Pather repeatedly, but he has remained silent. I anticipate I may have to return here to report receiving partial payments without any payment plan agreed to by me. According to the contract, the full amount was due to be paid in full, yet so far that has not happened. Tomorrow, 22 July, I will be taking time out of my day to go to the police during work hours to open a theft case. After that, I will proceed to the Randburg Magistrate Court to open a civil claim against them. This has caused me stress, sleepless nights, and frustration. The dealership shows no remorse, urgency, or respect for their legal obligations. Avoid this dealership at all costs. If you consign your vehicle here, be prepared to chase your own money while they hide behind excuses. This is a betrayal of trust and a serious warning to anyone considering doing business with them.
