I took out Debt Review with Debt Busters in October 2016.

I was retrenched in November 2016 and managed to make two full payments to Debt Busters. I contacted them immediately after I was retrenched and the man dealing with my account said that I was not to worry. I could just wait until my UIF pad out and could carry on paying as normal after that, he also advised that I did not have to worry as I was protected by Debt Busters.

In February 2017 I was asked to complete a change of circumstances form and just to inform my creditors I had been retrenched. Immediately Wesbank came back pulling out of the debt review saying I could not be under debt review if unemployed and demanded the full arrears to be paid immediately. When I tried to get this resolved with Wesbank I was told that I was short R 200 on my legal fees so they could not complete the process of getting a court order in place. Not once did anyone say that I was short of R 200 and that a court order was not in place. My contract with Debt Busters states that the first two payments would be for legal fees and the rest would go to my creditors. It actually not my problem that they could not get the court order done in the first two payments.

I asked Debt Busters what I would need to do in order to get my Debt review process back on track. I was told I would need to bring all my creditors up to date on my own as well as pay the missed Debt review instalments. How exactly does this help me. I was following the advice of your office and now this has turned around and bitten me. When I reported this to the head of the department I was told My case is complicated and that I was in beech of the contract as I had missed instalments however Debt Busters is also in breech as they had not gotten the court order in place with the first two instalments as per there contact. They are completely refusing to take responsibility for this and now my car in the process of being reposed.
