<p>Yesterday ( the 27th February 2017) I went to the Imperial Auto Actions to with the aim of buying a vehicle.</p> <p> </p> <p>I managed to bid for a 2011 BMW 320i START (E90) for R60 000 which was on LOT 46.</p> <p> </p> <p>After paying for a vehicle I immediately realised that the vehicle was involved in a car accident and it seems like the car is a code 3 even though the papers says it’s a code 2.</p> <p> </p> <p>Other material defects that were in the vehicle but was never disclosed to the public includes, but not limited to the following;</p> <p> </p> <p>1. Also when the employee of the Auctioneer was driving the vehicle out of the premises, there was faults like a noisy engine which should be displayed to the public but was never displayed</p> <p>2. The vehicle was smoking</p> <p>3. The vehicle was over heating</p> <p>4. The vehicle had smoke coming out of the engine</p> <p>5. The vehicle was leaking oil</p> <p> </p> <p>All the above was never displayed to the public and I raised the issue with the Auctioneer and they refused to consider my appeal.</p> <p> </p> <p>I have requested that they take the car back and give me something of the same value but they refused.</p> <p> </p> <p>The Law / Consumer Protection Act</p> <p>In South Africa the rights of the consumer are protected through legislation aptly named the Consumer Protection Act. A first step for any vehicle buyer would be to ensure that the auction centre is compliant with the Consumer Protection Act.</p> <p>This Act requires from the auction centre to fulfil certain obligations including:</p> <p>The display of any faults of the car in writing for the public to view. Even faults like a noisy engine should be displayed to the public.<br />Prohibiting an auctioneer from knowingly misrepresenting the value, composition, structure, character, quality or manufacture of the goods put up for sale at an auction.<br />Affording consumers a reasonable period of time and opportunity to inspect the goods on offer prior to the commencement of an auction. [No fee may be charged for such opportunity.]</p> <p> </p> <p> </p>
