Please do not be fooled when you see media reports of the information regulator taking action against companies, persons and other state organizations. Its a PR stunt.
The actual workings of the information regulator is not what you see. If you an ordinary citizen dont expect to get justice from them.
There is something very strange going on with a matter that was reported to their offices.
The information regulator on or before the 31st of January 2025 had already determined that the responsible parties in my complaint had breached the POPI Act and had failed to report this breach to myself and their offices when they became aware of this breach in 2024.
They are still dragging my matter out coming up with all sorts of excuses and to date no action has been taken by their offices. They informed me in written communication in February this year that their investigation report will be completed in 90 days in which today is the 90 th day and they still have not concluded on their report.
They previously asked for more time with no satisfactory explanation as to why they need more time when it was already determined on or before the 31st of January 2025 that the responsible parties were guilty of the trangressions.
Two external escalations to their offices requesting them to justify why they need more time went on deaf ears. I even went as far as allowing them an opportunity to explain why they will not have completed their investigation report within the 90 days with no response at all, although there wad acknowledgements of my escalations.
They are duty bound in accordance with common law principles, Section 40 of POPI act 2013 and section 76 (2) of the POPI act to have concluded this matter within a time period which is reasonably practical. They have shown no cause as to why it was not reasonably practical to conclude their investigation report in those 90 days and are just simply not responding and doing whatever they please. I now have to approach the High Court to seek an order to compel them to complete their duties. What is painful is that most people dont have the funds to afford the High Court. I am a bit lucky as I have had quite abit of experience loding court applications by myself and learnt alot when working with a previous trade union, however most other people have to just sit back and let this happen.
They are really doing an injustice to the ordainairy citizen in favor of big corporations. I however will not let this go away.
