Sad to know that when it comes to POPI ACT Violation there is no one that can investigate this matter. That also explains how ones personal information gets to be scattered all over and you can't sue that person because one have to email this pathetic Information Regulator the documents with evidence but nothing comes off it- perhaps we as South Africans don't have an INFORMATION REGULATOR??

Please do not be fooled when you see media reports of the information regulator taking action against companies, persons and other state organizations. Its a PR stunt. The actual workings of the information regulator is not what you see. If you an ordinary citizen dont expect to get justice from them. There is something very strange going on with a matter that was reported to their offices. The information regulator on or before the 31st of January 2025 had already determined that the responsible parties in my complaint had breached the POPI Act and had failed to report this breach to myself and their offices when they became aware of this breach in 2024. They are still dragging my matter out coming up with all sorts of excuses and to date no action has been taken by their offices. They informed me in written communication in February this year that their investigation report will be completed in 90 days in which today is the 90 th day and they still have not concluded on their report. They previously asked for more time with no satisfactory explanation as to why they need more time when it was already determined on or before the 31st of January 2025 that the responsible parties were guilty of the trangressions. Two external escalations to their offices requesting them to justify why they need more time went on deaf ears. I even went as far as allowing them an opportunity to explain why they will not have completed their investigation report within the 90 days with no response at all, although there wad acknowledgements of my escalations. They are duty bound in accordance with common law principles, Section 40 of POPI act 2013 and section 76 (2) of the POPI act to have concluded this matter within a time period which is reasonably practical. They have shown no cause as to why it was not reasonably practical to conclude their investigation report in those 90 days and are just simply not responding and doing whatever they please. I now have to approach the High Court to seek an order to compel them to complete their duties. What is painful is that most people dont have the funds to afford the High Court. I am a bit lucky as I have had quite abit of experience loding court applications by myself and learnt alot when working with a previous trade union, however most other people have to just sit back and let this happen. They are really doing an injustice to the ordainairy citizen in favor of big corporations. I however will not let this go away.

Despite reaching out in good faith, my experience with Mr. Linda Bobby-Jones Mhlongo of the Information Regulator has been deeply disappointing. His handling of my complaints was marked by a dismissive tone and a condescending approach, showing little regard for the seriousness of the issues raised or the impact on my family. Rather than seeking ways to uphold and enforce the law as mandated by the Regulator’s role, Mr. Mhlongo appeared more focused on finding reasons to close the matter prematurely. This kind of indifference reinforces the growing public perception that certain government institutions function more as symbolic structures than as bodies committed to justice. It is difficult to place trust in systems that prioritize administrative closure over accountability and public protection.

I complained to the information regulator of South Africa last year 30 June 2022. The regulator has acknowledged my emails with all evidence. They have investigated the party responsible and escalated the report to the relevant unit to make decision. Suddenly the investigators resigned but no word from the regulator office to let me know about the changes. Email of the investigator I used to contact is closed and I can’t contact anyone anymore for updates. Their office line is always down. Attempts to contact National Assembly in South Africa and escalate the matter has failed as I believe the party I reported has power and control over the regulator based on what is happening here. I will seek other avenues as I refuse to rest on the matter. South Africa has laws and those who have money can be excluded from observing the laws. It may take me years to win against the powerful and untouchable but eventually someone will open the door and hear me.

It is advisable to not go to the Information Regulator, as truly they serve no purpose. I have now been to the offices to find most of the third floor empty. There's absolutely a shocking environment. Racial preferences, and work ethics oozes absolute displeasure. After all you can just approach the court anyway. Then, worse then having to meet the true irony of the justice system, you deal with these members and they have no regard to actually listen and understand, if the adjudicator works there. Mine just resigned with no warning and I had found myself fighting to get somewhere, I have already communicated with many members including seniors, who have proven nothing but poor work ethics, understanding, and The tenacity to pick up matters that "information" is shared. My matter involves Mr Delivery and this as their agents, only because they already stated that their systems are 100% and no error is found. So I must be believed that it is intentional that Mr Delivery's agents sent a document containing my Identity Number, home address, name & surname, cellphone and email address to a third party, THERE IS PROOF!!! Even though this was shared the information regulator still is adamant that there was no breach of the Protection of personal indemnity Act. So in summary just approach someone who is willing to fight for you, or do it Pro se - up to you. I have started my own litigation to further this matter.
