Misleading Pricing & Undisclosed Fees
I wish to report my recent experience with Koos and Mike Cars in Vanderbijlpark, which raised concerns for me regarding pricing transparency and compliance with the Consumer Protection Act (CPA). I had shown substantial interest in a BMW X3 and engaged in several days of communication with the salesperson, Jaco Boshoff. When I called to arrange a viewing—having indicated that I would be driving from Pretoria to Vanderbijlpark—I was only then informed that the advertised price was not the final price, and that an additional R20 000 “detailing fee” would be required. This disclosure came very late in the process, and in my view, only at a point where a consumer might feel committed to proceed. I did not request detailing, and I was willing to purchase the vehicle in the condition that it was when advertised and at the advertised price. If detailing was completed prior to advertising, it is my understanding from the CPA that the cost should have been reflected in the advertised amount. To illustrate: it would be similar to advertising a vehicle, and only once a buyer is ready to conclude the deal, informing them that new tyres had been fitted and they now need to pay extra. I was advised that adding undisclosed fees after the fact is inconsistent with the CPA’s requirements for full, upfront disclosure and protections against practices that may mislead consumers or create unreasonable terms. This experience has caused me to lose trust in the transaction, and I believe other consumers should be made aware so they can make informed decisions. I intend to escalate the matter to MIOSA for review, and I encourage anyone who may have had a similar experience to follow the appropriate complaint processes as well. As always, consumers should exercise caution when engaging in transactions where pricing information is not fully disclosed upfront.
