Elizabeth Ming, id no 7404100293080, has no scruples. She is sitting on R 21,000 of funds owed and does not engage on how and when she will refund the funds owed by her. We are now in a process to recover through the Western Cape Rental Housing Tribunal, and lodged a case. The managing agent LuxeryNites, aren't assisting in recovering the money either in respect of a Seapoint property occupied, 263 Main Road, Arrow Court. Both Elizabeth and LuxeryNites accepted the monthly lease payment in advance for period of 18 month. The prepaid electricity account pertaining to the property is also in arears and a constant The prepaid of R 600 would only unlock R150 on the meter. Ming is a delinquent landlord and shouldn't be trusted with lessee funds.

LuxuryNites (Lovis Gaultier) is an Estate agent who appears to have ignored the fundamental principles of the EAAB. My experience started when LuxuryNites responded to my Gumtree Ad for a Professional Estate Agent to represent an overseas landlord and willing to work based on my specific Ad's requirements and the fee structure I required. When I was satisfied they understood my requirements I signed a 12 month lease and all appeared to be going well. Each time a new tenant was found the apartment, I was informed, required between R15,000 - R30,000 of work before the new tenant could occupy. I'm overseas and had to defer to the professionals input. At the end of the third lease I was contacted by LuxuryNites telling me I needed to repay the tenants deposit. I had never held a deposit and thus was puzzled why LuxuryNites didn't repay as they had done for the previous two departing tenants. Upon further investigation I discovered LuxuryNites had used the incoming tenants deposit to repay the departing tenants deposit because they had used their team to conduct repairs based on the outward inspection and thus earned from the work, effectively using the deposit. When there was no further funds to access the issue surfaced. I know for a fact (have invoices as proof) the tenants deposits should be kept in a separate interest bearing account, returned at the end of the tenants lease. I guess the smell of profit was to good to pass up. Now that it's not possible to claim any compensate from the EAAB for an unprofessional Estate Agent. I can now only suggest avoiding them or have it in writing that LuxuryNites holds or doesn't hold the deposit. Not sure how helpful they'll be in finding a new tenant when they cannot earn money from repairs. Choose wisely money doesn't come easily unless you're LuxuryNites.

TO WHOM IT MAY CONCERN: My name is Edith Okwara and I have recently entered into a Lease agreement with LuxuryNites(signed 31st December 2017) My problem is as follows: First, their agent initially gave me the wrong information, saying I need to pay a TOTAL OF R14,500.00. I am aware that the Lease stated two months deposit but went with the verbal advice of the agent. I deposited the money yesterday and then spoke to the agent again, who then pointed out that I needed a two month deposit and not one.At that point I opted out of the Lease and decided to use my "cool off" period to assist me to get my deposit back. Luxury Nites now say I forfeited my money as my dealings with them were as a result of Direct Marketing, in that i contacted them for the rental. According to legal advice I have been told that this clause would only work if I had made the agreement with the last known tenant of the building.I did not.I dealt only with their agents and feel that it is unfair and rather suspicious of them to withhold the full R14,500.Also, the lease has been modified without my prior knowledge or consent. I need urgent assistance.I have not taken occupation of the premises and have informed the Agent of my intent to withdraw.
