The owner of the townhouse I was renting passed away and my lease came to an end with Mimi's Real Estate and after about 2 years of not having a lease the executor of the estate gave me notice to move out and that there would be no claim against me. I contacted Mimi's Real Estate to advise her that I had been given notice and to find out when I would be paid my deposit. Once I have received my deposit, I saw that she had paid me R3863.00 short. Her reason for the short pay was: 1. For a fine that I had received for my dog making a noise but the body corporate did not follow the correct process and Mimi's Real Estate was told not to pay it. Keeping in mind that I only moved into the townhouse because Mimi's Real Estate confirmed that I could have a dog. 2. My toilet was broken from the previous tenants, and I had to fix it, so I held back the rent and advised Mimi's Real Estate who then told me to pay for the fixing and take it off the rent which I did but then I get charged interest for late payment. 3. If I am given notice to move out how can Mimi's Real Estate take off a R2000 cancellation fee.
I contacted the rental tribunal for assistance and OH MY WORD that was useless.
