The Protection of Personal Information Act (PoPIA)
DIRECT MARKETING BY MEANS OF UNSOLICITED ELECTRONIC COMMUNICATION
The general principle reflected in Section 69 is that if the data subject “That’s You” does not consent to the processing of his, her or its
personal information for the purposes of direct marketing, the Responsible Party “That’s Us” will not be allowed to use the data subject’s
personal information for this purpose.
The Responsible Party is allowed to approach a data subject (by whatever means) to request the consent of
the data subject.
You may very this statement on this link:
https://popia.co.za/section-69-direct-marketing-by-means-of-unsolicited-electronic-communications/
“Personal information” means information relating to an identifiable, living, natural person, and where it is applicable, an identifiable,
existing juristic person. Nikkel Consult does not hold any information as such to identify you as a living person and requires you to give
consent by requesting permission to speak contact you.
This act is very new and there are a lot of misconceptions regarding what is allowed and what is not, that is why we put together the above
to help you understand that no Laws were broken by you receiving a call, as consent to approach you was done.
Regards
Management
Best regards,
