(My) Home Owners Submission GENERAL COMPLAINT & CONCLUSION I was sold a property which is a lifetime investment of mine, under the pretext of false advertising False advertising, misleading information and deception was used to rob me of my hard work and dreams, and that is wrong and very unfair. Every day I regret making the purchase. Yes, perfection does not exist but daylight robbery and unfairness does exist, and every day it is a constant and painful reminder to myself, my dreams and aspiration, hard work and money. According to the OCCUPATIONAL HEALTH AND SAFETY ACT, 1993 Act No. 85, 1993 OCCUPATIONAL HEALTH AND SAFETY ACT, 1993 subsection: lnvestigations 31. (1) An inspector may investigate the circumstances of any incident which has occurred at or originated from a workplace or in connect!on with the use of plant or machinery which has resulted, or in the opinion of the inspector could have resulted, in the injury, illness or death of any person in order to determine whether it is necessary to hold a formal investigation in terms of section 32. (2) After completing the investigation in terms of subsection (1) the inspector shall submit a written report thereon, together with all relevant statements, documents and information gathered by him, to the attorney-General within whose area of jurisdiction such incident occurred and he shall at the same time 10 submit a copy of the report, statements and documents to the chief inspector. (3) Upon receipt of a report referred to in subsection (2), the attorney-general shall deal there within accordance with the provisions of the Inquests Act, 1959 (Act No.. 58 of 1959), or the criminal Procedure Act; 1977 (Act No. 51 of 1977), as the case may be. " . . .''''' .' 15' (4) An inspector holding an investigation shall not incur any civil liability by virtue of anything contained in the report referred to in subsection (2). The inspection should have detected that the whole infrastructure is not acceptable and non-negotiable as our life's are in danger. The whole infrastructure is an insult, a mediocre and broad daylight robbery to me as an investor- one property is an investment too!! I wonder every day how ABSA Bank approved this whole structure and my unit. Everything is of poor quality from the veranda tile to the toilet handle and everything else Why? How did NHBRC approve this scam of a supposed project of BRINDLE MEWS? Words do not and cannot describe what goes on in my mind, spirit and heart every minute regarding my investment going down the drain every day. NHRBC's Findings:- Utter nonsense and insult!!! UNIT ** . Leak underneath the kitchen sink resulting to the kitchen cupboard being damaged. . Poor plaster finish behind the refrigerator. . Vertical crack next to the plug point in bedroom 1 and bedroom 2. . Diagonal crack at the window opening less than 1mm in bedroom 2 visible on both sides. . Separation crack between door frame and masonry walling in the bathroom. . Crack at the opening in the lounge. . Sliding door faulty and not cleaned. . Gap on the floor tile in between the sliding door. . ABSA BANK -BRINDLE MEWS COMPLEX Please visit 125 Brindle Place, Zoek Vallei, Newlands EAST, Durban 4037. A newly (recently) built residential complex that brings no joy to me but utter misery and unnecessary financial constraints. As a black person, I have been ripped off by ALLEY ROADS CONSTRUCTION and FIRE HORIZONS INVESTMENT DEVELOPER (PTY Ltd), NATIONAL HOME BUILDERS REGISTRATION COUNCIL and ABSA bank funding my mortgage loan. It is a terrible mediocre and insult to to my intellectual capacity and financial status of the dominant race, young black investors- me! Banks, NHBRC, construction company, developer and BOT members and property managing agent, Vision Property have no willingness to assist me as a home owner but instead are turning a blind eye. This terrible situation has caused mental illnesses, diseases and a great financial loss to me, the home owner. I have been very unhappy for the longest of time with the property and Infuriated at being sold dream and pouring thousands of rands down the drain monthly. A dream was sold to me in comparison to the Bluff property built within a white community by the same company, developer, conveyancing attorneys (NEDBANK) and banks (ABSA). Why??? ABSA bank funded a project and property it knew very well that it was a terrible infrastructure and now is running away and failing to take ownership, reminding me that they are a financial institution and blocking my calls and emails. As for NHBRC, I am also blocked on their communication avenues; and as for the exorbitant and no use levies is a painful joke because the property complex is not maintained at all!!! I have leaks and mould within my unit and have lost out of almost 20 potential buyers since I listed the property with ABSA since May 2022 but until today it stands unsold, moldy and being vandalized and the SAPS doing nothing about it after opening a case with them. I am in a financial and unnecessary financial and mental rut all because of ABSA!!!! Does ABSA deserve from me paying my monthly bond repayments?? NO!!!!!! Telkom, please advise on how does one's contract end and you do not notify or end the mobile contract with the customer automatically, but automatically place the customer on a month to month contract without any agreement or contract signed by the customer and you, Telkom the service provider? I owe you, Telkom a sum of R252 for a service I did not use and had no agreement with or knowledge of!!!!! How does that happen?????? Pure and utter rubbish Telkom has been!!!! If this is not sorted out before this month ends and clarify your criminal act of day light robbery to your customers, I sure will take this up because clearly your services are of criminal acts and inconsideration and selfish thinking!!!!!!!!!! I DO NOT OWE YOU, TELKOM ANYTHING!!!!!!!!!!!
