Dont even bother raising your complaint to the MIOSA.Rather engage with a attorney for help. Myself and my wife put a complaint on the 10 January 2020 regarding a dispute with Bidvest McCarthy Toyota Durban north,we sent our supporting documents and they only gave us a reference number and case Manager.We emailed plenty times in March,April,May over the lock down and no response although they were working remotely.Then we called in May 2020 and we were told that we didnt call for an update so we need to wait longer.We waited till August and called again then a guy said they were going to escalate it as the case is delayed for to long,no response at all.Again we called in September 2020 then another guy said the previous guy didnt escalate it and now he will escalate it,still no response after.Again we called in a week later and a lady said we need to wait 30 working days after escalating the case.Finally on the 5th November 2020 we received our first response and final verdict from the MIOSA.The verdict was very biased and also the case manager didn't touch base on certain aspects of our complaint.They gave us 7 days to appeal and we did appeal it on the 6th day.No response at all from the MIOSA then a week later we called in and a lady said they have closed our case.This was rather frustrating for us because we waited 10months for just a biased verdict and then for them to just close our case without giving us a chance. The MIOSA is very misleading and they are not referees between a consumer and a motor Dealership.They infact are there to protect dealerships and we have proof of that today. They just take your complaint and supporting documents and foward them to the Dealership.After the dealership receives it then the Dealership has the opportunity to communicate back and forth with the MIOSA to protect themselves. We on the other hand never got a chance by the MIOSA to communicate one bit from January 2020 to provide more proof against the Dealerships allegations who have wronged us,discriminated us,didnt repair our car properly and pushed us into the deepend. Take a thought of this guys(After 10months with our complaint with the MIOSA,we had no chance to communicate one bit,then on the 5th November 2020 we received our first response and final verdict.They gave us a chance to appeal it and we did a appeal the verdict but they just closed our file without informing us. The closed file that the MIOSA provided to us shows that the Dealership responded to them on the 17January 2020 after our complaint and were given the opportunity to communicate back and forth but when we kept on emailing and calling from March 2020 till September 2020 the MIOSA had no response for us.Clearly and proves the MIOSA is protecting the Dealership from getting into trouble. We now are engaging with a attorney to help assist us in sueing them all after 11 months of pure waste. Again dont waste your time with the MIOSA and dont allow these Dealerships to take you for a ride.
My vehicle a(Toyota etios) picked up a whinning noise in the gearbox plus other sort off issue with it.After much back and forth with Toyota Umhlanga,they acknowledged the issue and decided to replace the releaser bearing in the gearbox.After them repairing my car the problem was still there and it was told to me that there is nothing much they can do and I can take my car for a 2nd opinion to another Toyota Dealership.I then decided to go with that, so I took my vehicle to Toyota Durban North and then it was when my nightmare began... The workshop Forman @ Toyota Durban North test drove my car and he advised me to take my vehicle to Gearbox center for them to test drive it again and give me a report which needs to come back to them because Toyota does not deal with gearbox issues and a Gearbox specialist will have more knowledge to give me a exact report.It was also told to me that Toyota Durban north deals with Gearbox centre in Springfield park. After Gearbox centre confirmed there is a major problem with the gearbox and giving me a report, I got back to Toyota Durban North with the report and they agreed to sort out my vehicle.During this time I was also in communication with Toyota SA as I had a case with them once I discovered that Toyota Umhlanga had not done a proper job with my vehicle. After dropping of my vehicle @ Toyota Durban North for them to sort my vehicle out. I was promised that no decision etc would be taken on my vehicle until everything is discussed with me 1st or Toyota Sa. That never happened, myself and my wife had to do all the chasing to get feedback from the dealership about what is going on with our vehicle. What really took us by surprise was when we spoke to the workshop Forman after 4-5 days of dropping the car off and he informed us that they could not find the defective part in the Gearbox so they have already made a decision to replace all the components in the Gearbox and they have already ordered all the parts for our gearbox,they should receive the parts by Monday and they will start with the repair on our vehicle. When we questioned them about why have they chosen to repair and not replace the gearbox,they informed us that they are unable to find any defective parts in the gearbox so they are opting to replace all the components in the gearbox and the warranty will not put a new Gearbox. This to us sounded very strange because the Gearbox is now being repaired twice and stripped off the car twice already, so we should get an opportunity to decide whether we want it repaired again or replaced by law.Well we didn't authorize the repair and we contacted Toyota SA to inform them of what is going on. Toyota SA informed us that Toyota Durban North has not followed protocol with regards to the warranty and communication and they where going to speak to the dealership and see what is going on. Nothing good ever came off that as Toyota SA ended up siding with the dealership and kept trying to get us to give in to the dealerships terms. After seeing that we are getting no way with Toyota SA and the Dealership. The Dealership manager of Toyota Durban North threatened to put our gearbox together and return our vehicle without repairing it. We were very upset and we needed our vehicle so we authorized them to go ahead with the repair. After Toyota Durban North was done with our repair and informed us that we can collect the vehicle, we informed Toyota SA and they promised us that upon picking up our car they technicians will be present to test drive the vehicle with us to make sure all was in order, however that never happened. The vehicle was test driven by the workshop manager who knew nothing about the faults before when the car came in. I never at all said to the workshop manager that the vehicle is fine because when we just drove around a small block for a test drive, all I said is that i am not happy with the repair plus i will have to drive it for awhile before I can get back to them. After driving my vehicle for a few hours I picked up that the vehicle is still the same and it now also picked up a vibration, like loose feeling on the steering wheel plus hard gear change. We immediately contacted the dealership and informed them of this and the Dealership Manager had the cheek to lie and say that i said the vehicle was fine upon collection. At this point we had enough and it was getting frustrating to deal with.All was told to us from the Dealership Manager is that they cannot do much now and we are more than welcome to bring in our car and do a evaluation and take a new car.(very easy for them to say that and brush the problem aside) We did not give into that decision of doing a evaluation and then we decided to do our own investigation without the help of Toyota. We took our vehicle on a personal level to the very same Gearbox center that repaired our Gearbox a week ago when Toyota Durban north dealt with them on that case. So now this time it was like my first visit to them coz I now dealt with a different specialist yet from the very same Gearbox centre. After the guy at Gearbox centre test drove the vehicle, he mentioned the issues and gave us a report to state that the gearbox is whinning and it needs to be striped an repaired.WOW isint that a surprise when Toyota Durban North said there is nothing more they can do. This really shocked us and got us very upset. We informed the dealership of this report we got to back us up because 1. They didnt follow protocol. 2. They made they own decisions on or vehicle without considering us. 3.Forced us to go ahead with the repair. 4.Turned us away stating they have fixed our car and it is fine. 5.To prove they have not fixed our car. They then advised us to bring the vehicle back for a check up after refusing at first.We also informed Toyota SA of the same but they didn't seem to be shocked of the news, they just wanted us to continue doing this back an forth with the dealership. The next day we noticed the vehicle picked up a very bad oil/greasy leak, noise in the suspension and after that we inspected the car ourselves and we found some things to be rather shady in the way they have repaired our car.So we decided to drop by the dealership for them to take a look at the leak, and other bad repairs that were done to the car.When I got to the dealership I was told to take a seat and in a few minutes later the guy from Gearbox center who gave me the report at the office walks in and then comes back in from the workshop with the Dealership Manager.They both approached me and she informed me that she wanted the guy from Gearbox center to test drive my vehicle, at that point I refused because I immediately picked up that this was a trick to get the guy to change his story now coz I have caught them out in a lie. The Forman from the dealership then test drove the vehicle with me and insisted there's nothing wrong with the car.Regarding the leak they told me to wait for a ramp so they can check under,I said no problem and waited. The Dealership Manager then approached me again with the guy from Gearbox center and I told her straight out that I don't wish to speak to him or for him to test drive my car as I have a report already and that's it, the Dealership manager tried all that she possibly could to get an reaction out of me coz she saw I wasn't giving in to her nonsense and silly claims.On top of all that behavior,she was being rather rude,sarcastic and speaking about irrelevant stuff regarding my car that has got nothing to do with the Gearbox.I refused to give into her and she left back into the building. Before my vehicle could go on the ramp I asked the guy who was taking my details if I could go in and show them exactly where the oil/greasy stuff was leaking from and he agreed its fine I can go in. I waited for them to put my vehicle up, then i proceeded to go inside the workshop to point out the leak and bad repairs. However again the Dealership Manager followed me and interrupted me and refused for me to go in and point out the faults claiming that it is not safe for me and they know what is the problem, however I needed them to see exactly where the fault was as the workshop guys knew nothing.As the vehicle went up, the Dealership manager and her two Forman went under my car and were busy discussing and im not sure what.Me looking eagerly and to know what they are up to after they lies, I then proceeded to go under my vehicle and point out the faults.As pointing out the faults the Dealership manager had no words to explain to me but she kept on being rude and instructing the guys to lower my vehicle while I was still under it,she could of injured me.She didn't want to give me a chance to show them how bad its messed up and kept on talking over my voice. She then asked the guys to drive my vehicle to the front for me to leave.Beside all of that she was following me all over the Dealership like im a criminal so I dont get info from anyone.When the guy drove my car around, i questioned him about what are they going to do, he just raised his hands and said to me that he doesn't know and i must call the dealership and find out. And again after all that she waited for me to leave the yard at Toyota durban north. They still didn't take responsibility for anything or send myself or Toyota SA a report uptil now. I contacted Toyota SA and still they didn't help us. All they did was insisted I go back to the dealership.(How can you go back when you got pathetic treatment and lied too). We called the dealership again and asked for an appointment so they could check the vehicle up properly in middle December 2019 but they refused and gave me a date on the 2nd January 2020 yet all of this happened in December and we needed our vehicle to go on holiday.We had to rent a car to use over the holiday as our car was in bad condition to use.When it came to the 2nd of January we couldn't take our vehicle for them to have a look as we were still on holiday.But they never bothered uptil now. After this I decided to report the Dealership to the Motor Industry Ombudsman because I honestly believe that Toyota Durban North did a terrible repair on my vehicle and they robbed Toyota Warranty and myself coz it would have made more sense for them to replace my gearbox rather than repair it again and now its messed up. They also mislead customers and treat them unethically when they try to point out they wrong doings. Toyota SA was also supposed to be a customer service to assist customers however they side with the dealerships and give customers the run around also. From December 2019 uptil now in July 2020 our vehicle is parked off and cannot be used because of Toyota and they shady repairs,lies and not wanting to take responsibility for they actions.Yet I must still pay for my car that I cannot use. Toyota has proven to be a brand that can not be trusted. People need to think twice before buying a new car from Toyota. Friendly service when buying a car but poor and unfair service when they need to fix your car. I cant even imagine how many others are taken for a ride like this by Toyota. I will surely use all my proof to deal with Toyota Durban north for what they have done to us and how they have treated us to suffer for absolutely no reason. From today as a Toyota owner of vehicles, I am no more a believer in the brand. I am hoping Toyota can get back to me and resolve this issue as thisbis totally unacceptable.
Totally disgusted in the way Toyota Durban North handled my repair on my Toyota Etios and for Toyota South Africa not assisting me to get help aswell.I urge people to be really careful in trusting Toyota when bringing your car in for a repair. My car is a 2017 Toyota Etios Sedan, bought brand new and still under warranty. Between September October and November 2019 my car had sat many times at Toyota Umhlanga for the repair of my Gearbox,after many times back and forth trying to explain to them,they then brought a Gearbox specialist to tell us nothing is wrong with our car plus going threw a long battle with them.Then they acknowledged the issue and decided to change the releaser bearing in the gearbox as they have mentioned that is the problem after all.After repairing my gearbox and on the day of picking up my vehicle at Toyota Umhlanga.Straight away I brought to the attention that the car is still the same and nothing has been changed to sort out the problem.They then mentioned to me that there is nothing more they can do and I must take my car for a second opinion to another Toyota dealership.So after the long battle with this dealership for absolutely nothing and waste of our time I then contacted Toyota South africa for help.Toyota South Africa then advised us we have a case and to take our car for a second opinion the week after as it was a weekend. We took our car to Toyota Durban North that nextweek around the 17-19 November 2019. All went well with they staff assisting us then test driving our car and then again advising us to take our car to a local Gearbox centre they deal with to confirm our problem with the Gearbox on our car.The very same day I took my car to Gearbox centre in Springfield park for a check up.Upon the guy at Gearbox centre test driving the car and then also taking the car inside the workshop,jacking the car up at the front and doing another inspection,He then confirmed that the car has a huge problem with its gearbox and needs to be attended to.He gladly gave me a writen report on what needs to be done so I can produce it back to Toyota Durban North and I left they yard.So at this point I was very upset but surprised and shocked at the same time as to what is going on now because Toyota Umhlanga gave me a battle but then repaired my car for absolutely nothing then mentioned they cannot help me anymore,Strange. This is when our story started. After producing the report from Gearbox centre to Toyota Durban North we waited about a week to give our vehicle in for the repair because we went threw another battle with them getting us a courtesy vehicle for us to use as we didnt have a spare vehicle and the dealership mentioned the repair could take up to 3 weeks to fix or more but depending on the parts. We finally got our courtesy vehicle and we handed our car in for the repair.Upon leaving the dealership they mentioned to us that they will contact us when they start with the repair of our vehicle and let us know of the way foward. It went on for about 5 to 6 days and no call from the dealership on the repair then we decided to call them to find out.Called in and they mentioned they will call us back with feedback.We then got a call from a guy who was part of the repair and he mentioned to us that they stripped the box and cannot find any defect with the parts in the gearbox but they are replacing all the components with new ones.So i mentioned to him that why cant you guys replace the whole gearbox with a new one instead of replacing all the components with new ones because yourl cannot find any defect.His response to me is that they cannot replace with a new gearbox as per warranty.He then told me that they are still busy working on it but will resort back to me going foward later in the day but i never got a call back. So they didnt even have the decency to inform me or Toyota South Africa what is going on and it took me to call them to tell me the way forward yet all along they started working on my car .Reason why they suppose to inform me is so I can communicate with Toyota South Africa going foward in our case and Toyota Durban North was fully aware of our case and to follow protocol. So the challenge got harder everyday having them to replace my gearbox with a new one and not repair it because at first my gearbox was stripped at Toyota Umhlanga and repaired and it was a failed mission and now they Stripped down the gearbox the second time. That is strain on my car and its still new. After our many requests for a new gearbox we then got to deal with the General manager of Toyota Durban North and she was not helpful or friendly at all.She sent us a email that if we donnot accept the repair of our car then she will put our gearbox back in and give us our vehicle back.So now aint she a nasty and pushy manager of Toyota. Also beside all these challenges Toyota South Africa did absolutely nothing to help us.The only thing they said was sorry we cant do this and we cant do that plus protect the Dealership. We then accepted the repair as we needed our vehicle back and there was nothing Toyota South Africa could do to assist us and the Dealership that was repairing our car plus we also needed to give back the courtesy car as our time with it was up.So Toyota Durban North knew what they was doing and forced us on the repair. So I called in also to ask what are they really doing with the repair because they were so busy bossing us with the repair that they didnt even inform us properly on the repair. So my first question to the Service manager is that.( Are you guys replacing the clutch because with the gearbox having a issue it can affect the clutch with wear and tear plus the clutch forms together with the gearbox.His answer was (No) because there was no defect with the clutch.So my reply to him was that you guys replaced all the components in my gearbox yet there was no defect but you dont change the clutch because you believe there is no defect.The dealer manager has no answer for me and complains to Toyota South Africa that I am being hard with them and they need to deal with me futher. So long story short.After couple days they had repaired my car and informed me to pick it up.As per Toyota South Africa they technicians will be there when I pick the car up to test drive it with me to make sure I am happy with it although im still not happy with the repair. On that Friday 13/12/2019 I arrived to pick up my car and when I got there Toyotas Technicians were not there to test drive the car with me as per Toyota South Africa.The Service manager decided to get in and drive my car to test it around the block and take note that he was never the one who test drove it at first and to acknowledge what issue are we looking for that is sorted out. My words to him in the car is that I am not happy with the car and the repair and I need to drive and use it first to confirm there is no problem. The very same afternoon after picking the car up and driving it,myself and my wife contacted the dealership and Toyota South africa straight away and informed them that the car has not been sorted out and it is still the same and infact worse. Another challenge began with them and Toyota South Africa to sort out our car.They then informed us that there is nothing they can do further to help us. Our next step for assistance is I dont know where as Toyota South Africa even failed us and we are now sitting with a car with hard gears and a whinning noise from the Gearbox. We then decided to do our own investigation.I went to the very same Gearbox centre in Springfield that gave me a report at first to take back to Toyota for the repair and this is the very same workshop that repaired the gearbox and sent it back to Toyota Durban North to put back.As I walked in on a personal level and not sent by Toyota this time ,I dealt with a different guy this time and explained my issue with the gearbox and to please tell me what is wrong with it and to give me a report on what needs to be done.The guy then test drove the car with me in it and explained to me that the gearbox has a whinning noise and gears abit hard. After the test drive he gave me a report stating that the gearbox is whinning on a number of gears and it needs to be stripped and quoted. (Now this is when it really upset me because this was the very same Gearbox centre that repaired my gearbox the week before by Toyota Durban North and Toyota Durban North claimed there is nothing wrong with my car and there nothing much they can do to help my after that repair)Means I must now **** off. This is what you call robbery of customers or Toyota warranty. After my report that I got the second time personally from Gearbox centre I sent it to Toyota South Africa immediately and they was shocked about it,and thats when the suspicious behavior started from Toyota Durban North towards me. With that report I also mentioned to Toyota South Africa that my car is not the same. It was leaking gearbox oil all over and under the car,front suspension was making a noise plus there was a safety bolt missing that attaches the gearbox to the chasis. Toyota South africa then informed me to take the car back for them to check it up when I have the chance and I donot have to book it in. Now this is when the bad behavior from Toyota Durban North starts. On the 20/12/2019 I took the car to Toyota Durban North dealership for them to asist me with the issues I am not sitting with that they have caused on they side after the repair. When I walked in I was informed by the lady in the front desk to have a seat and the Service manager will assist me in a moment.I took my seat and waited for over 10min,while waiting at that time I could feel a bad vibe around me and staff looking at me.(So it clearly shows that they have received information from Toyota South Africa that I am on them for messing me around).Next minute I see the guy who test drove my vehicle and gave me the second report with regards to my cars gearbox from Gear box centre walks in and goes to the back.And then the next minute the guy from the gearbox centre who walked in,the guy that works in the Toyota workshop plus the general manager of Toyota Durban north,3 of them comes in and introduced herself and the two other guys.At that very moment she rushes me out with them speaking to me about my car and them attending to the issues I have at the moment.(Also she behaved in a sarcastic way when speaking and saying my car is rather old and what happen to my bumper and if I had an accident.I then told her sorry Mam that has got nothing to do about what I came here for.I then also refused for the guy from Gearbox centre to test drive my car as there was no reason for that coz he already test drove my car at his workshop and confirmed what is wrong and plus gave me a report about it in writing.(So why was he there in the first place to test drive my car again.Well he was there to change his story to make it seem as if nothing is wrong with my car and to protect himself and Toyota Durban North from they lies and he was clearly put up by the General Manager of Toyota Durban North to change his report but I still have a writen report which still stands.When I refused again and again for the guy not to test drive my car she got rather angry and funny with me and told me okay there is nothing more to speak about and she walked in. Regarding my issues that I came in for initially I had to seek assistance from the staff as she didnt assist me.When the guy came out to make a job card for me and to take my car to the back to inspect what is wrong and were about the gear box oil is leaking badly etc.I asked him permission if I could just go in they workshop quick when my car is up and show him were about this issue is,he gladly says yes Sir you can show it to us as we want to know what are you referring to. When I walked in the dealership to get to the workshop at the back I was followed everywere by the same General manager who had the confrontation with me outside.I was so upset and wanted answers that I had to ask staff for information regarding my car but everyone was quite and scared as the General manager was on my tail.When my car got up the ramp I took a step outside to proceed to my car to show them the issues,I was then stopped by the General manager and ordered that I cannot go into the workshop at all.When explaining to her that I did ask permission for this so I can point out the problems to the guys.She tells me abruptly that they know what is the problem and she is incharge of the place so I need to not come in there.So I waited inside and I watched her walk towards my car and then under my car with her two workshop guys then having a conversation under my car. At this point I got messed around so many times,treated badly by her and made a fool and she makes me wait inside while they secretly have a topic about my car and not explain to me so I lost my patience and made my way to my car.When I got under my car they all got stunned and I started pointing out the mess they have caused and was asking questions.They all kept quite and didnt have a answer for me plus the General manager aswell.Makes me wonder that they didnt want to alow me in the workshop and had so much to speak about when i was not there but when I got there it went to silence.The only thing that was said by the General manager at the time under the car is that its for my own safety not to be under,she is incharge and I need to come out from under please coz they are putting the car down.So desperate she was that while I was under the car she ordered them to put the car down and it happened so i had to quickly come out the way. After that happened she walked in the Dealership and I was furious telling her that she is a rude and arrogant person.She gladly laughs her way speaking to other customers about me.I still was seeking answers from staff but everyone was afraid to speak to me so I decided to go out and cool down and wait for my car. When the guy then drove my car from the back to hand it over to me,then again the general manager was on my tail again. I asked the guy who drove my car to me .Sir were is my report and what should I do now.He then raises his hands and says I don't know anything and I have to call in to find out.I was shocked at they behavior and then jumped in my car and i drove off coz the same General manager was looking at me and waiting for me to leave they premises. Uptil now we have not received a report from them.We have explained our terrible experience with Toyota Durban North to Toyota South Africa and still they have done nothing to assist us. Toyota South Africa only insisted that we take our car back to the same Dealership to fix but we refused as they treated us very badly and acted very suspicious.We are aware that if we take our car back to them then they will find a quick fix to take themselves out the hole and get out of trouble. We are now sitting with a car that we cannot use from December 2019 but we are paying for it.And Toyota South Africa refuses for us to take our car anywere besides A Toyota dealership.Then also refuses again for our car not to go to any other Toyota dealer beside Toyota Durban North.How obvious. We will not be taken for a ride twice and I will not rest until I take Toyota Durban north down for what they have done to me. As Toyota paying customers and followers. Its sad to say that I will not buy another Toyota vehicle because of the way I was treated and taken for a ride. I now cannot find it in myself to trust or believe in TOYOTA the brand.After all the suspicious behavior,lies and also assistance from Toyota South Africa for the help we need.
