Found the information I exactly needed, now I know which way to go.
I have been a member of FNB Law On Call for more than 15 years and in 2018, I had a problem when a careless driver drove into my car and the my car was damaged. I approached LOC for assistance. To my surprise the attorney who assisted referred me to a small claims court. He never explained anything to me, what they could not help me. I am currently having a problem with a shop, whereby I bought the drone for my son. They sent me a faulty drone and I returned it back at my own expense. The shop is refusing to give a refund for the money, I paid for the drone. They want to fix the drone and I don't want a fixed drone.I need a refund. I approached the LOC again and the attorney who helped me, referred me to a consumer council again.I received a message from them saying "your claim had been closed". When are this guys going to help me instead of referring me to government services where the matter might take years to be resolved? What are we paying them for?
On the 17 April 2023 I ordered a drone from a shop calling itself "Djiauthorisedretailers" and the drone was shipped to me on the 19 April 2023 by a shop called Brandhubb. On the 22 April 2023, my son unpacked the box and started to operat the drone. It flew only 3 times and it started showing an error "non official battery used". I phoned the shop but the phone was not answered. I sent an email reporting the problem. As it was over the weekend, I waited until monday .At around 16h00 there was still no response from them.I phoned again and luckily the phone was answered by the gentleman, who said I must return the faulty drone. He never mentioned anything about the shipment fee back to them.I paid R130 to send the drone back to them.Another cost on my side, as if it's my fault that they sent me a faulty drone. Before I returned the drone, I was told to send it to the address on the invoice, suprisingly there was no address on the emailed invoice. I had to call again, to be given the address, which is another expense on my side. The drone was sent back and I received no confirmation from the shop that they received the drone.I had to call once more and Iwas told that the drone had been sent back to the supplier to be checked. I stated from the beginning that I want to be refunded my money as I don't want to spend any money in future, sending the faulty drone back to them. Nobody from that shop who answered me wanted to entertain my story of the refund. I was told that the supplier has responded by saying the drone is still under diagnosis but there was no time frame. I sent emails reminding the store manager that I don't need a fixed drone, I just need my money back.I read their terms and coditions before I ordered the drone. As a customer, I am entitled for a refund, if I returned the faulty item, within the first 7 days of purchase. There was no response on the issue of refund. In the first week of June, I sent another email, requesting for a refund. I got an answer from the store manager saying I will get the refund on friday, as they do all refunds on fridays. On the day of the refund, I received an email from the store manager, saying unfortunately we can't give you a refund, as you have been placed on a warranty list. I sent an email again reminding the store manager that I don't want that drone anymore but he never responded. On the 21 June 2023, I received the email from courier guy that my shipment from Beandhubb is on the way. I was never informed about the shipment of the fixed drone by the store manager. I sent an email to the store manager asking him if they are forcing that drone on me. He responded by an email, saying the matter has been escalated to management and that one of their managers will call me, which never happened. Yesterday the drone was delivered to my house and I did not accept it. Staw away from this shop and save yourself from lots of frustrations😭😭
