Loaned musical instrument defective by Brixton Instrument Library
I was loaned a too small 3/4 violin with frayed, aged strings. I requested a full sized violin for adult use from get-go. I have been unable to either play the instrument nor to return it presently due to acpersonal crisis. The library was made aware of this. I am unhappy with the instrument loaned to me. It was not checker properly by the owner. I called before going in to the library to discuss my needs to learn and to ask specifically the size instrument that would be needed. The instrument was not pre-checked not made ready for me to collect on arrival. This involved a significant wait & cost & inconsideration as a third party taxi driver was kept waiting, also. I was made to sign a contract signing away my consumer rights under The Consumer Protection Act. I was concerned by contract given me. I loaned the instrument trusting the advice that it was in good order. The owner asked why I had not returned instrument earlier ? I explained my circumstances that repairing the instrument mid-loan was not part of my available time frame and as per contract for loan of a working instrument. New deadlines of crisis proportions had evolved. I made library ware of this on each communication we had. I offered to pay for the instrument initially in the shop on leaving. I was unable to do this by debit card. I realise now that had I paid the deposit and rental - neither would have been recoverable. I do not trust I will be able to recover the situation amiccably given the clauses included in contract re: instrument rental defects held to my liability? Thesecdefective aged strings were not to my account. The aged state of violin strings with one fraying was initially brought to their attention, & questioned, & the owner said dont "turn it too tight" & dismissed my query. Subsequently, my query proved well founded on my experience that followed. The string questioned snapped within 4 days. I was not able to go by taxi to recover the defective loan of an instrument not in good working, nor in a reliable order to use fircduration of the first month. The string snapped as expected. I lost faith, & motivation, in the libraries bona fides to pursue this at this time. I appealed to the library to waive the urgency to return as I had critical deadlines to meet with a crisis at home. I asked the owner and support administrative person Hester if the violin was urgently needed as there were scores of other violins unused on the shelves? Last week, I came down with swine flu so I am too infectious, to be able to come in with my being so ill.
I received a letter of demand for thevdeposit & rental claimed owing. I reject this claim as the instrument was not loaned to me in good condition. I do not wish to have usecofcanother instrument. I trusted the loan in good faith and I have been sorely disappointed. I understand the library's concern about the well being of said instrument. I have assured them in person by phone of its safe return. I reject a letter of demand to be made to pay for the loan of a defective instrument with old strings. This is tantamount to holding me hostage for purchase new strings? This is unacceptable.
I also made it very clear on the telephone why I was not able to return the instrument until my deadlines to recover my home & health had passed. This has been completely ignored.
