WDP/COLL/IH1189 There was a balance of 685.02 when the summons was issued and to that, fees was added. I must say that I am surprised that you would issue a summons for an outstanding amount of R685.05 when you have already been told that the person is unemployed. By doing so you have assisted in putting him in a worse position as he must now pay R1595.61 (statement date 30/10/2024).
I have offered to pay R300 per month starting last month – attached proof of payment. I have also asked for an updated statement on the 05 November 2024 which I have not received.
The person is unemployed and maybe you would like to incur more costs by investigating this?? He therefore cannot afford to pay you. He lives with me and has nothing of value that you can attach.
I, his mother who is a pensioner can offer to pay you R300 per month which I have since started paying. I must just add that I am not legally liable to pay this but just offering my assistance.
You may accept this or wait until he finds employment which can take time taking the unemployment rate into account.
I am just adding, again that if he only owes R685.05 why are you issuing a summons for R3124.44 which was the original amount owed before he made many payments.
