I’m extremely disappointed with how Nimble Group conducts itself. This company is unprofessional, evasive, and constantly avoids giving straight answers. I have repeatedly requested my prescription letters, as I am fully aware of my rights under the Prescription Act and Section 126B of the National Credit Act (NCA). Instead of responding appropriately, they continue with trickery and vague communication – clearly hoping I won’t know the law. For the record: If a debt has not been acknowledged or legally acted upon in 3 years, it is considered prescribed, and a consumer is not legally obligated to pay. It is ******* for any company to collect on prescribed debt. I am demanding a formal written confirmation that the debts have prescribed – and until such proof is given, I will not entertain further contact. Nimble Group – you have 7 days to respond in writing.
Dear DMC, I am writing to formally request written confirmation regarding a prescribed debt that was previously associated with Markhams TFG account. In terms of the National Credit Act (NCA) and the Prescription Act 68 of 1969, the account in question has prescribed, as it has been inactive for more than five years. I have never made any payments toward this account, nor acknowledged the debt in any way. TransUnion has also confirmed that the debt is prescribed, and the account is currently reflected as closed on my credit report. Despite this, the prescribed debt appears to have been sold or handed over to your organisation, which is in clear contravention of Section 126B(1)(a) of the NCA, which states: "No person may sell a debt under a credit agreement to which this Act applies and that has been extinguished by prescription under the Prescription Act, 1969." I have previously attempted to contact your office regarding this matter but have not received a response. This lack of communication is unprofessional and unaccaptable I therefore request that you provide, without further delay, a formal letter confirming: That the account has prescribed and that the matter is now considered closed. Your urgent attention to this matter is required
Dear Nimble Group, I refer to my previous correspondence regarding the account listed in my credit report, which has prescribed in terms of Section 10(1) of the Prescription Act 68 of 1969, read with the National Credit Act (NCA). Despite granting you 20 days to respond via email, you have failed to acknowledge or provide the required prescription confirmation letter. I also wish to place on record that TransUnion has confirmed that this debt has prescribed. In terms of the law, once a debt has prescribed, you are prohibited from attempting to collect, list, or demand payment thereof. You are further compelled to furnish me with written confirmation that the account has prescribed and that no further collection action will be taken. Please note that I have already escalated this matter to the National Credit Regulator (NCR)
