Absa *****. Absa’s Systemic Violations of Consumer Rights & Banking Laws As a victim of Absa’s predatory practices, I detail their ******** actions: *****ulent Misrepresentation & CPA Deceptive Advertising (CPA Section 40): Absa promoted a "transparent" business account but concealed the "unauthorised cheque balance" fee. This "bait marketing" misled customers about true costs. Engineered Penalties Monthly admin fees deliberately forced my account into a negative balance ******** Fee Structure & Debt Trapping Self-Created Penalties: Absa manufactured a negative balance *via their own fees*, then penalized me for it—an abusive loop violating CPA Section 48 (unfair fees) and the Banks Act’s "fair treatment" mandate. Debt Trapping Scheme By blocking closure and charging penalties for their manufactured deficit, Absa created an inescapable cycle mirroring "advance fee *****." ******** Intent & Regulatory Breaches Systematic Concealment: Fees were buried in fine print or omitted entirely, breaching CPA "plain language" rules. Breach of NCA/Banks Act: If the account included an overdraft, penalty fees were unreasonably disclosed and app****, violating the National Credit Act. They just closed my account and tool my money just like that.
a victim of ***** from ABSA, THIS IS WHAT I HAVE GATHERED AMONGST MY CLIENTS WHO HAVE THE SAME ACCOUNT WITH ABSA. Absa Bank has engaged in deliberate financial ***** by luring us into a business account under false pretences, then systematically ******ing money through a rigged fee structure. After opening the account based on misleading advertising that concealed predatory charges, Absa forced my account into a negative balance using unjustified monthly fees only to then penalize me with over R2,000 in 'unauthorized cheque balance' fees for a deficit they created. Worse, when I attempted to close the account to escape this ****, Absa refused, trapping me in a cycle of fabricated debt. This is not banking it is theft, and I demand immediate restitution and accountability, I have attached the email forwarded after I called their business line and the fee structure that they advertise vs what I have been charged, this account is not in use and that has been the case for over 7 months, it continues to charge this, I have an complaints email I sent seven months ago as evidence. Absa’s actions: Never disclosed the "unauthorized cheque balance" fee upfront. Buried it in fine print (if at all), violating the CPA’s "plain language" rule. Engineered the negative balance via monthly admin fees, then penalized you for it. → This is "***** by omission" (withholding critical facts to induce agreement). 1. False Advertising & Deceptive Account Opening I was misled into opening this business account based on Absa’s advertising, which: Failed to disclose the existence of "unauthorised cheque balance" fees. Did not warn that monthly admin fees could force the account into a negative balance, triggering further penalties. Promoted the account as "transparent" while hiding predatory fee structures. This is *****ulent misrepresentation under the Consumer Protection Act (CPA) Section 41 and constitutes unfair business practices. 2. *****ulent Fee Structure Absa is deliberately running a **** by: Charging monthly admin fees that artificially push the account into a negative balance. Then penalizing me with "unauthorised cheque balance" fees (totalling over R2,000) for the negative balance they created. Refusing to close the account unless these *****ulent fees are paid, effectively trapping me in a cycle of debt. This is not a legitimate banking practice—it is a deliberate scheme to extract ******** fees. 3. Violations of Law & Consumer Rights Absa’s actions violate: CPA Section 41: Right to cancel services without penalty. Banks Act: Duty to act fairly and transparently. National Credit Act (NCA): Prohibition of unfair fees. Common-law *****: Intentional deception for financial gain. BELOW IS AN EMAIL FROM THEIR BUSINESS REPS I HAVE NOT BEEN DEBITED NOR HAVE DEBITS GOING TO THIS ACCOUNT, THIS FEE IS CREATED BY THEM FOR THEIR CHARGES. Dear Lindi Thank you for your email request. Case reference: C-55892067 Kindly be advised that the unauthorised charges refer to debit order that you and the other company that has debited you have made an agreement with to debit your account. Absa charges you for the reversal of that which means when opening the account charges gets explained and agree upon them, please do send us the name and account number of business so that we can request your banker to explain more on the matter. We trust that all is in order. See our self-service features on our Banking App: 1. Tax certificate 2. Statement 3. Confirmation of account letter. Use the Absa Banking app or Internet Banking website to make and receive immediate payments Why go to the branch when you can request a stamped statement for 3 months or more from your phone, using the Absa Banking App To confirm your banking details, you can easily request a bank confirmation letter from the Banking App or Internet Banking at your convenience. Kind regards Sylvia Francis Virtual Business Consultant Relationship Banking: Virtual Channels AGAIN THESE ARE THE VIOALATIONS Violation of the Consumer Protection Act (CPA) Section 40: Prohibits "bait marketing" (advertising terms that don’t reflect reality). Absa advertised a "business account," not a "fee trap." Section 41: Grants the right to cancel services without penalty. Absa blocked account closure to keep charging you. Section 48: Bans unfair, unreasonable, or unjust fees. Penalizing you for a negative balance they caused is unjust. → These violations make the fees legally void. 3. Breach of the Banks Act & NCA Banks Act: Requires "fair and equitable" treatment of customers. Absa’s fee structure is abusive and one-sided. National Credit Act (NCA): If the account has an overdraft, fees must be reasonable and disclosed. Absa’s penalty fee is neither. → The South African Reserve Bank (SARB) can penalize Absa for this. 4. *****ulent "Debt Trapping" Scheme This is a predatory financial loop: Absa forces a negative balance (via monthly admin fees). They then charge you for being in the negative. When you try to escape, they refuse to close the account, demanding you pay their fabricated "debt." → This mirrors "advance fee *****" (a ******** offense). 5. Evidence of ******** Intent Systematic: This isn’t a "mistake"—it’s a repeatable fee-extraction model. Concealment: Absa never warned you this could happen. Obstruction: They blocked account closure to continue charging you. → Meets the "dolus eventualis" standard (foreseeing harm but proceeding anyway).
I dont know why its taking so long to get a product i have already paid for, but im over it, can the consultants stop giving me the run around and refund me
You contact ***** and dont get through, and when you do the consultant hangs up. you try again they say they will look into it and contact you and that never happens
I am so tired of complaining about this, after resolving this you would assume they would sort it out once and for all. The honoring fee makes no sense funny thing is every consultant agrees that it's an invalid charge but it never goes away. You can't charge clients a fee for purchases they have already made. There is no overdraft on cheque accounts. Why are do they insist on having this fee.
This has to be the worst company we have ever encountered. They are bullies and ****mers of note. We do not know why they insist on charging property owners when we have the city of Johannesburg to answer to. They will not clarify their charges or communicate with owners they will interfere with your water and electricity even if you're on prepaid and then invent services to charge like renovating the pool every year. No one needs their services, our body corporate chairman resigned because of them, and we have no other choice but to seek legal assistance because of their abuse. They take advantage and claim to be appointed at AGMs that home owners know nothing about and more importantly have not signed into agreement. If anyone sees this and has a horrible experience with @Prestigemetering please reach out to us.
Vodapay for smme is a scam, since November 22 my company was promised delivery of a portal after we went through a strenuous process of which involved providing sensitive information, our ID copies our business certificates bank information, to find out that their agents are capable of lying... the business partners are worried about the then use of said information if not for the availability of the payment portal. we have called them for over three weeks and their response is the same, spoke to three of their agents which gave us different stories of what's happening and lied to us, saying we will receive a call and the issue will be resolved. we reached out on Twitter, and their social media team keeps us in a loop of responses that say please wait for feedback?? feedback on an issue that the agents said they resolved???
This has to be the most dramatic experience of issues.. from a technical issues agent blatantly lying to me just to have a ticket closed. I even remember his name Linda from vodacom Fibre technical problem. To an agent experimenting whether they could sort it out or not. I have spent 9 days without Fibre somehow I think this was on purpose because then I would have to buy vodacom data everyday. I have spent R600 on data in 9 days.. just so I could work. Each day being promised that the issue will be fixed.. and I believed them. Instead of getting another Fibre provider... I really want vodacom to reimburse me... I would have long switched by now Instead of buying data everyday to get my work done. It's the least they could do at this point
