Dear Sir/Madam, I hereby lodge a formal complaint in terms of Section 136 of the National Credit Act (NCA) and the Credit Bureau Regulations against XDS / Splendi for ******** and misleading reporting of three Lewis Stores accounts. This complaint includes an additional, serious breach: XDS displayed the same accounts simultaneously as “Written-Off” AND “Active/In Arrears,” which is factually and legally impossible under the NCA and CBA Data Code. 1. ACCOUNTS IN QUESTION Lewis Stores accounts listed on 22 November 2024 as: R33 118 – Written Off R15 072 – Written Off R29 609 – Written Off These were recorded as “W – Bad Debt Written Off” for 12 months. 2. RETENTION PERIOD EXPIRED ON 22 NOVEMBER 2025 In terms of Regulation 17(1) of the Credit Bureau Regulations: “Adverse information, including written-off listings, may only be retained for 12 months from the date of listing.”Thus: ✔ Legal expiry date: 22 November 2025 ✔ Written-off entries must be removed entirely ✔ Accounts must be marked Closed Other bureaus, including Experian, app**** this correctly. 3. SERIOUS LEGAL BREACH – DUAL STATUS (“DOUBLE REPORTING”) XDS / Splendi committed a major breach of NCA reporting standards by presenting the accounts as:This violates: ▪ NCA Section 70(2)(d) – data must be accurate and reflect the true legal status ▪ NCA Regulation 19(4) – credit bureaus must reject inconsistent data ▪ CBA Data Code of Conduct – final status codes cannot co-exist with active arrears ▪ Principle of Data Integrity under Section 68 A credit account cannot legally be BOTH:A “W – Written Off” status is a final, terminating status Once a creditor writes off a debt: 4. XDS THEN REMOVED THE “WRITTEN OFF” STATUS, BUT *******LY LEFT THE ACCOUNTS AS ACTIVE/IN ARREARS When the retention period expired: Experian correctly removed the adverse information and closed the accounts. XDS removed the “Written Off” flag BUT *******LY re-aged the debt and marked the accounts as Active & In Arrears. I have few points here: Bureaus may not revive expired written-off debt, Bureaus may not re-age closed accounts, Bureaus may not reflect arrears on terminated credit agreements, This behaviour is prohibited by NCA Section 71(2) – outdated information must be removed and CBA Final Status Code Rules – W (Written Off) cannot revert to Active, I now appear to have active arrears on accounts that should be closed. I request Immediate correction of my XDS/Splendi profile Remove all Lewis Stores entries entirely mark accounts as Closed (consistent with retaining rules). although Mimi had assured me that the adverse “Written Off” listings would be removed on 23 November 2025, the correction was only partially completed, and the accounts continue to reflect active and in arrears, which is ******** and inconsistent with the National Credit Act (NCA) and Credit Bureau Regulations. I submitted the following documents to support my dispute 1. Experian report (09 November 2025) – showing all three Lewis accounts listed as “W – Bad Debt Written Off.” 2. my Experian report (23 November 2025) – showing these same accounts correctly updated to “Closed” after the 12-month retention period expired. 3. XDS/Splendi report (23 November 2025) – showing the accounts incorrectly displayed as active and in arrears, even though the written-off status had been app**** for an entire year. If this matter is not fully corrected within 5 business days, I will proceed with a formal complaint to, The National Credit Regulator and The Credit Ombud,

I am extremely disappointed with the way XDS Credit Bureau handles consumer disputes and the accuracy of the information they publish on people’s profiles. Their listings have a serious impact on our lives — from job opportunities to access to housing and finance — yet they seem to publish information without proper verification or supporting documentation. When I questioned a listing under my name (Ref: XD15092025045), I was met with repeated delays and vague responses. Instead of providing proof of the alleged account or judgment, XDS told me to “take it to the Ombudsman.” This kind of response shows a clear disregard for transparency and accountability. Under Section 73(1) of the National Credit Act (NCA), a credit bureau is required to investigate disputed information and provide documentary proof within 20 business days — failing which the information must be removed. In my case, no such proof has been produced, yet the information remains on my profile. This is not just poor customer service — it is a violation of the National Credit Act and Protection of Personal Information Act (POPIA), which both require that only accurate, verifiable information be published and processed. I urge XDS and all credit bureaus to take greater responsibility for the accuracy of their data and to respect the rights of South African consumers. Our financial reputations deserve better oversight and accountability.

In terms of the Prescription Act 68 of 1969, this debt has prescribed and is no longer enforceable. Other registered credit bureaus, including TransUnion and VCCB, have already updated my profile accordingly. However, your records still reflect this debt inaccurately, which negatively affects my credit standing, these acounnts are Telkom who is more that 12 years 0ld , Letsatsi finance and Mpowa finance they all prescribed debts

Im giving Splendi 2 stars mainly because, they do respond to queries when posted on hello peter but that shouldn't be the case in the first place. I logged a dispute to update my MR Price account which was never in arrears at all and even sent through the letter from MR Price stating my account is current and up to date and also provided statements. The month of August now shows in arrears for this account on my credit report which is incorrect, and i followed up with MR Price as well and they also confirmed account is up to date, i need Transunion to rectify this immediately as this has impacted my good credit rating due to inaccurate information reporting. I sent through 3 emails already with the letter from MR Price and my statements

I just want to thank the Splendi and XDS team according to me they are the best Credit bureaus in South Africa. I have logged the same dispute with Experian and TransUnion that I have with Splendi XDS about 3 or 4 months ago. The only one that has resolved my issue was Splendi XDS till today I'm struggling with Experian and TransUnion to get my issue resolved. Keep up the good work and thank you very much for assisting me.

The information on here is terribly incorrect. You have my debit orders marked as UNPAID for the whole year on one of my accounts. I have 2 or 3 payments that came in late on that account, the rest were on time. Yet ALL are marked as UNPAID. The balance of the account is also sitting nearly 4 - 5 months behind yet the account is closing next month, making it look like I have 4 - 5 months of arrears. This is unacceptable and terribly misleading information for lenders. I am not being given the option to upload documents when disputing on the Splendi site, therefore can't submit the dispute online. Please rectify this with urgency.

I’m extremely disappointed with both Splendi and XDS regarding a serious inconsistency and possible misrepresentation on my credit profile. I had a personal loan with ABSA, which was officially written off on 28 May 2024. This write-off status was consistently displayed on my credit report for months, confirming the loan had reached enforcement action stage. However, to my shock, I pulled a new report this week and saw the write-off had been quietly removed — and replaced with "150+ days in arrears", while the account is now shown as active again! This is highly misleading and prejudicial. It falsely suggests that the account is still open and accumulating arrears, even though it was already written off — and ABSA hasn't contacted me with any reversal notice. In terms of the National Credit Act (NCA): A write-off is classified as an adverse enforcement action (Regulation 17(1)) and may only be retained for 1 year on a credit profile. - If the debt is paid or settled, Section 71A requires the bureau to remove the listing within 7 days. - And Section 70 of the NCA requires all credit data to be accurate and up to date — not silently altered to worsen a consumer's credit status. By replacing the write-off with 150+ arrears and reactivating the account, TransUnion and XDS have effectively: - Rewritten my credit history without notice, - Extended the lifespan of the adverse listing beyond the legal limit, - And created a distorted view of my credit status for any future lender. This is not just a technical issue — it has a real impact on my financial life, and it violates consumer rights under the law. I'm demanding: - Full explanation and supporting documents from ABSA or the bureaus about why the write-off was removed. - Immediate correction and restoration of accurate account status. - Removal of the account entirely if the 12-month retention period has already passed. If this is not resolved promptly, I will escalate the matter to the National Credit Regulator (NCR) and the Credit Ombud, with all supporting evidence. Enough is enough. Consumers deserve transparency and lawful handling of their credit data.
